 Regardless of what the creditors meeting is offering to you,regardless you voted yes or not to the Convenio, rights contained in Law 57/68 are imperative and inalienable. As a matter of public order.

Absolutley María. I think a lot of people think that once they are trapped in the Administration/Creditors Meeting process that they have no other option.

But their inalienable rights granted by LEY 57/68 are still valid.

So action against the Bank who accepted the off-plan deposit or issued the Generic Bank Guarantee may still be possible.

May I ask a question Maria?
For those who have no BG or generic BG, but have won first instance cases against the developer for breach of contract and find themselves in the position you describe above, can they by law force the developer to disclose the Banking information re where their offplan deposits were placed, and given this knowledge, would they then be able to place a claim against the Bank? This is relevant to all those who have been denied this information, so it would be of great benefit to have this situation clarfied.

We are in the same position as ANNE and we believe that this information regarding the Bank which held our money is vital. However ANNE says ............
"CAN THEY BY LAW FORCE THE DEVELOPER TO DISCLOSE THE BANKING INFORMATION"
What is the correct procedure for getting the developer to disclose this information, when he ignores our requests ????

There is now quite abundant case Law on this type of actions. We have won several of them ( out and in Courts)
