Legal tip 478. Why Law 57/68 has not been enforced?

Today on the forum:

Law 57/68 has not been fully invoked by Lawyers in Spanish Courts till very recently, that´s why it has not been fully enforced.

This lack of invoking/enforcing has been due, in our opinion, to several different reasons:

1) Lack of proper understanding of the Law, somehow motivated by its lack of clearity and precision, or due to a poor posterior development of the same.

2) Lack of the circumnstances that made it invokable.

3) Lack of  serious understanding of the need for putting external, pro-consumers limits to Banks´ acts and decissions. An oversupremacy of financial markets.

I read some time ago you were hoping to work with a group of people to try to get their deposits back under this clause in the law. Have you any timescales set and how long will this court case take if it goes through the quick court process that I think you or another lawyer reported is now in place.

These claims are made through regular declarative procedures, which depending on jurisdictions may take from 8 to 24 months.
