Those posh bad lawyers..

who made their businesses by ignoring basic principles such as independency and evasion of conflict of interest and were happy to set an international chain of  gambling- houses -Law - Firms under the protection of the Real Estate boom and the abuses of developers and estate agents..... those  lawyers who systematically neglected their obligations towards their clients, are now extremely " professionally cautious" to release the files of those clients to us.... hum!  If they had been that protective towards your off-plan purchases,if they had been that zealous with their clients´rights.... many of you would be in a different situation now.... and they would have maintained their business, which are ruined now.


We are very frustrated today:  itis almost five months since I asked them to release to us the files of some of our clients and they are just making excuses and playing around, putting the client´s interests at risk....

I already reported that to the Bar Association and will be reporting it to the Duty´s Court is they do not give the files to us tomorrow.

We are ready in third floor now.

Anyhow... we are in third floor, new office now.

Over the past few years there has been too much greed from lawyers, developers, agents and town halls and people like yourself are trying to clear up the mess.

i AM AFRAID THAT WE LIKE MANY BRITS ASSUMED THAT SOLICITORS HAD A DUTY OF CARE TO THEIR CLIENTS AND THAT THEY HAD AN ASSUMED INTEGRITY.
SADLY IT APPEARS NOT TO BE THE CASE LEAVING THE WHOLE OF THE SPANISH LEGAL SYSTEM WITH A TARNISHED REPUTATION. I HAVE SINCE FOUND THAT THERE ARE A NUMBER OF GOOD SOLICITORS IN SPAIN WHO DO MAINTAIN A DUTY OF CARE TO THEIR CLIENTS AND NOW HAVE A VERY GOOD EXAMPLE ACTING FOR US.
I HAVE READ SOME OF YOUR POSTS AND WISH YOU WELL IN TRYING TO PROVIDE A TRUSTWORTHY AND RELIABLE SERVICE TO YOUR CLIENTS.

I am one of the 'Stupid' off plan purchasers who accepted the advice of the estate agent, and used his recommended lawyer.

The recommended lawyer did not get the bank guarantee, even though the contract states that it would be provided. It never was.

I eventually changed lawyers and my new 'independant' lawyer is trying to recover my deposit, due to the developer being in breach of contract, as he is 2 years overdue with construction. The developer says he will return my money when he is able, but unfortunately he has no cash at the moment.

My question is this;

If the developer goes bankrupt, can I recover my money, by a legal claim, from the first lawyer due to his negligence in failing to secure the bank guarantee?

Any advice would be appreciated.
