Perhaps someone could speak to the BBVA gentleman and ask him to stop BBVA appealing when we have paid our money under the generic bank guarantee into their special account.

This would free up the courts, free up OUR money and perhaps we would have the confidence to invest into property!

I couldn't agree more.
But isn't this a directive that could also be reflected from within the Spanish Justice system on the basis that an appeal by the Bank is abusing the "system of delays" especially when Supreme Court rulings support claimants' legal arguments?
Why in instances such as this can't the judiciary take an informed approach to refuse a Bank's appeal, when the outcome inevitably falls in favour of the innocent purchaser and would save time, effort and money in the process?
Is an appeal ever analysed in this respect, or can an appeal never be refused?
