Refund of Deposit - Legal Action?

I have lost my deposit on Casares del Sol apartment. I have been contacted by a Spanish solicitor to try to recover my deposit, provided I pay 13,000 euros up front. I feel that this is throwing good money after bad. I feel that I should just walk away from it all.
