Hi we have had an offer on my sons apartment. My son has a girlfriend and they have a baby together, now my sons girlfriends father (babys grandfather) wants to buy the apartment. My question is can my son get away with not paying capital gains somehow? the grandfather wants the house to go into his daughter and the babys names. Is it possible to just add the girlfriends name and the babys to the deeds so they own it without actually going through the hassle and expense of selling it. Thanks

Hi#Janis,
I suggest you PM Maria de Castro, she is a lawyer on this site and may be able to help with some advice.
Good luck, let us all know what is suggested.
Kind regards, _______________________

The baby's name cannot be added until he/she is 18. There can be a transfer of title to the girlfriend but whatever proportion is transferred will be subject to 7% transfer tax. Without more specifics it is impossible to comment on the CGT situation _______________________
