Hi All,

My name is Ashok, first posting on this forum.

I bought  a 2bed apartment two years ago in phase 1. I dont know when the completion is and am now  thinking about getting a refund....what are my options??

I have not contacted PW  yet as  i gather it will not be easy but  thought of getting some info and  advise here.

any help will be greatly appreciated ..

(btw I bought it through parador)

We have just returned from Spain and have decided to pull out all together.  PW have offered us something else but we are still in impressed.  We have spoken with our solicitors and they are approaching PW to see if they will offer us a refund.  We have also given our solicitor permission to go to the town hall to find out when the building licence was issued for TDLT, because, if they have had the building licence longer than 18 months they are in breach of their contract with us.  My advise is to go through your solicitor and not contact PW direct.

First post also. First of all apologize for my poor english, I´m spanish. I´m in the same situation that Yantra-Ashock (Phase 1, 2 bedrooms,...) and I´m also interested in cancel the order. So please keep me also informed about the chances we have. My situation is different because I bought directly to PW.

Has anyone else been receiving mail shots from PW trying to sell key ready discounted properties due to non-completions?  Does it mean that people are not completing on the purchase of properties and are forfeiting deposits?

By the way, still haven't received the promised refund.  It's always "next week".

We had a property on terraza and changed to a key ready property on la torre. They are worth looking at as they are giving a good discount and at the end of the day you can seewhat you are buying and they are available straight the way and the facilitys are up and running. We are very pleased with ours on la torre as we can start living the dream now not in 2 yrs time.

Hi all

Very interested in Ruth's message regarding the building licence and being in breach of contract.  Have just been advised by my solicitor that PW are not in breach of contract because the contract time limits do not kick in until start of construction.  Please let me know if you have any success with this route as we really want to cancel but can't afford to lose the money.  Below is part of an email from my solicitor confirming when licenses were issued, hope this helps.

Further to our recent correspondence with regards to the commencement of building Works at Terrazas de la Torre I can confirm that I have had several conversations with Polaris World on the matter and having checked the “Official Bulletin of Murcia” (town hall) I am able to confirm that Polaris World were given permission to start to build by the mayor of Torre Pacheco back in April 2007. The plans of the urbanisation were pre-approved before the properties went on sale in 2006, but they have asked for further permission to begin to build now that the infrastructure is in place and all plans have been approved for electricity connections, drinking water, road access, etc.

We have just heard from our solicitor and PW have told her they will not give us a refund.  I have asked her to try again, we have a feeling that the first request will always be a "NO".  I will keep you posted on how things go.  If anyone else has been successful in PW agreeing to refund (even if they have not got the money yet) please let me know, also, it would be useful to know which solicitors you are using.  We still feel that the solicitors we have are not fully on our side as they were the ones that Parador Properties advised us to use, hence, they may have an unoffical connection to PW or Parador.  We really are in a "break kneck" situation now and desperately need help. 

Just a useful bit of info.   When we met with our solicitors and they took a look at our contract they queried a section in it and said that this was not normally in a contract.  We will be asking WHY this was not pointed out to us by them before we signed the agreement.  Has anyone else been told this?

 PLEASE HELP IF YOU CAN.

Hi Ruth.  We got our full refund on Tuesday.  We chased it ourselves because we didn't trust our solicitor who was recommended by the agent.  It took 6 months and was very frustrating.  Like you we bought on Alhama and were then moved to TDLT.  The reason PW agreed to give us a refund was because they cancelled the building of our phase, which was originally phase 3 and was reclassified as phase 9.  I understand that only phases 1 & 2 are to be built.  Why did they offer you another apartment on a different site?  Is it because you are on one of the cancelled TDLT phases?  You need to find out for certain which one was your original phase.  If you are on one of the cancelled phases then you are entitled to a refund because they are in breach of  contract.  Alyson posted the details of her solictior on this forum earlier.  He secured her refund in a matter of weeks.  Perhaps you should give him a call.

Holly many thanks for the info,, unfortunately we are on phase 2, but I will get the solicitor to double check this detail.  Our solicitor has approach PW and they have turned us down, but, we have told the solicitor to go back to them and push for it as we have not been given a reason for it, also, we think that PW will say NO to anyone asking for their money back, first time round.

Hi Ruth

In May you mentioned that Polaris may be in breach of contract if they have had the building licence for longer than 18 months.  Did anything come of this?  

We have this week been advised by Parador that hand over of phase one is now scheduled for Jan - June 2009, with no start date for phase 2, but completion not before 2010.  Polaris have also refused to issue our 2nd bank guarantee despite being a legal requirement..  Getting really worried about our money now.

We like many others were visited in Nov 2007 by a Polaris rep from the London Polaris World offices as we were on phase 3 of TDLT which is nolonger being built - offered alternatives but opted for our money back. Despite numerous phone calls to both the London and Spanish Polaris World offices, Designer Homes in Pymouth that we purchased our apartment through and emails we were no further foward in getting our refund and decided to seek legal advice through a solicitor in April 2008. Well guess what....... we are still waiting for our money and last week customer services told us that they cannot tell us when our money will be returned, 64, 000 euros is a massive amount of money to be waiting for!! We are in the position that we are very lucky and do have 2 bank guarantees which our solicitor now intends to use, although this will still cost us more money and probably some time to arrange. To date we already have incurred a £1000 solicitors bill which will continue to grow and my mortgage goes up in August as we borrowed the money for our deposit 2 years ago, expecting our property to be completed later this year.........how niave we were!! I even sent what I felt was bordering on a 'begging' email to the Director at the London Polaris offices to see if he could assist us at all - he infact has done nothing and when I phoned asking to speak to him was told I could not and would be put through to customer services in Spain. The Polaris dream and concept we believed in has been totally shattered and as a company they have no customer care commitment what so ever.......... no matter what anyone says.........those of you that continue to look for the Polaris concept and dream.....good luck to you as you are going to need it!!
