Richard,

 

I was out at Condado this week viewing properties that are with CAM. Some have many parts missing i.e. door off, kitchen doors, cookers, plumbing not finished etc.

Just be careful. I went and picked one that was in good nick as you buy as seen with these although the price is good. they are going fast though. I have info on some I looked at but mine were all 3 beds. Can you let you know if you wish.

Thanks a good point from Darren, ALWAYS view the property before commiting yourself.

Come along, stay at the resort ( there are many rental properties to choose from ) make sure you like it, them start looking at property. Alway view the properties and do you own snagging list in yout head, if there are too many faults walk away and look at the next.

Many people have had damp problems due to leaks, if the property shows ANY signs of damp or water leaks walk away, I'm sure the agent will try and tell you that all has been fixed but dont risk it, go for a property with no history.  The properties are all four years old'ish so pick one that has weathered the years with no leaks.

Are you coming to live here or just a holiday home?

I agree with little tinkers

Ikea or shop around if you have time. In our opinion the other alternative can work out expensive & you dont always get what they promise, though I am sure that is not the case with all companies but still expensive,.

There are some good reliable companies that will bring furniture over from the uk to Spain

In the "good old days" four years ago there was a great guy named Alan ( I think,) who bought furniture over at a silly price. Unfortunatlyn he has moved on.

We shopped  locally  here in the uk. Taking advantage of some great sale prices. but the cost did incure bringing it over.

Like Phil. I would also advise  to rent first. even for just a few days to see if you like it. thought I am pretty sure you will

Thanks folks,

certainly will note the leak issue and shopping around for furniture, im visting next week to view, sure the agents going to apply the pressure but ill resist to properties that look iffy or smell damp.

Phil are the leaks from rain e.g roof terraces or internal pipework?

Some of the upstairs apartments ( <10% ) suffered from leaks on the stairs to the roof terrace which causes damp in the bathroom and front front, steer clear of any that show signs of this. a few had leaks caused by other problems but the major problem is the stairs not being sealed correctly.

Thanks Phil, assume its the flashing/sealing that fails? Do you know what the units are built from, concrete or brick?

I read something about Presidents for each Jardine then up the chain to the committee, do they only decide on Jardine issues or the resort as a whole? Regards richard

take a camera and note pad

do your snag nist on the property you intend to buy

dont make the final payment until you have inspected and confirmed the works as complete you may need your keyholder or friend who may live there to check they are complete if you cant do so.

take it from a builder. if you look closely the build quality is not as the good as the uk QC is not as strict. they are however at the current price great value for money and look the part.

furniture. we furnished our fiirst in a week including lighting. the second we did in 5 days. tip on Ikea - Ikea sell the same gear as here so do your homework here know what you want before you go over. we got our white goods from iroski in Murcia shopping centre for the first one however; now shut down. in the same area is leroy merlin and media mart. we bought all the white goods from media mart second time round. they deliver and fit for you all in the price.

best tip is to be organised list out what you want and plan each day - then follow the plan. doing it yourself is rewarding and a lot cheaper - if your able to do it in the uk then its no different in Spain

That used to be the process with Polaris and should be the same with anyone

however they are selling at a hughe discount so could be bought as seen

guess you have the cash and cash is king

For these properties you cannot submit a snagging list or have any repairs done, so check them very carefully and if you need the looked at professionally we can offer this servuce including a quotation to repair any defects

Even though they are sold as seen they still have to be sold with a 10 builders guarantee, same as NHBC, which is like the NHBC system in the UK, an insurance based scheme, and your lawyer should be checking that this is in place, before completion

In this way you can cover any potential construction defects

 All properties on CDA enjoy the 10 years structural damage warranty, appliances like cooker have a 6 months garantee after contracting supplies when sold newly, otheriwse not. CAM bank sells sold as seen, many of the apartments offered need maybe some tlc but are still a bargain. Regards, Rupert-Quality HOmes Costa Calida at Al Kasar

I am not sure what you mean by waive all latent defects because this is latent defect n. a hidden flaw, weakness or imperfection in an article which a seller knows about, but the buyer cannot discover by reasonable inspection. 

Doesd it mean that the accept to rectify them

Patent defects are those that cam be seen on inspection without having to lift floors or remove items

Normally for a new property in Spain you get 2 other levels of guarntee in addition to the 10 years which again is the law in Spain

1 year on any additional snagging dfecets, both patent and latent, form the date on which you complete

3 years on anything that renders the property non-habitable, leaking roofs windows, damp etc

The problem with the 10 year bond is if you are within the first 3 years and there is a problem the insurance company may refuse to accept a claim

It is worth asking the seller how you stand on these 2 legal requirements

my contract states below

 

"The sale shall be carried out by the entity

owning the property as-is, in the physical and legal

situation the property is in and the parties signing this

contract declare that they are aware and accept

such situation, therefore waiving the right to

compensation for latent defects".

 The legal term is sold as seen, in Spanish "cuerpo cierto", there is no way to claim anything form the seller especially as the seller never has lived in there so definitly does not know about possible disperfects, just accept that you will be responsible for anything which needs attention. As stated there is still 6 months garantee on appliances and the 10 year structural damage warranty. Regards, Rupert
