 Legal tip 636. Great for Burgos and Valencia on the defence of buyers against Banks in off plan purchases 


If you bought a property off plan in Balcones de Mijas from Gestion Deporte 98, S.L. and you did not receive an individual certificate of Bank Guarantee, you might be interested on this:

 

Together with last one by Murcia, new Case Law ones coming out by Burgos and Valencia deffending the obligation of Banks to refund, in cases where individual certificates of Bank Guarantees were not handed to buyers.

 

In essence the protective character of this wise Law dated 1968 plays the big role in favour of buyers who advanced good amounts of money for something that initially is just an architect plan.

 

Law 57/68 made Banks guardians of buyers amounts, in what it is a very correct approach with a great sense of balance of markets and limits to the strong parties.

Quinnhave declined the indemniy against Leslie Alberici and partner ,even though most of us have seen a copy of the Disciplanary Tribunal,there was no Mention of Fraud,so why as she not been indemnified??
Quinns cannot be allowed to get away with this,especially as no reasons have been forthcoming,
We should all be uniting on this one,they have strung us along for far too long,our legal expenses gone through the roof,for them to keep us dangling and then say up yours.
Let us all get together on this and unite,we have all lost a lot of money through OVP and Leslie Albericki CUK Coveyancing,and I feel someone should
Get to the bottom of it.
Our solicitors are going to try and arrange a meeting for us with counsel,as to where we go from here.

Since when as Quinn been above the Law Society.

hi maria

i own a property on this development which i have being paying a mortgage in full to caja espana for 3 years

the whole site is empty (no water ) (no electric) the bank owes all the site except ours we cant use our property and the bank will not give us answers even our lawyer cant get a answer

what legal rights do we have against bank ???
