I think it is a good idea to start this specific thread as we are now nearing completion and need to consider our new community. When I spoke to Perla last week she advised that the community charge for those in phase 1 would be approx 75 euro per month this could be more or less depending on the size of your apartment. . It is also important to point out that all 3 phases will become one big comunnity when the development is totally finished, this was also pointed out to me by Perla. This is easy to understand when you look at the main access road for phase 1 & 2, the carpark access for phase 3 is accessed via this road. Also the phase 3 building will be accessed on foot using a bridge at the back of the builing to access the pavement on the main access road up to the site.

Let's think about our preferred administrator.
In Spain administrators are legally responsible for keeping notes of the meetings, getting things done (contracting gardeners, builders, cleaners etc), bookkeeping etc. The community decides what it wants, the president has the day to day responsibility to act on behalf of the community, but it's the administrator who has to get things going. In a large development like ours this will certainly be a professionals job. There are lot of administration offfices which offer their services.
One of the important issues is what to do with the administrator. It's usual that the developer puts somebody in place. Quite often these people or businesses are involved with the developer in some way and so are not the most trustworthy when it comes to negotiating with the developer. The second problem is you don't know if he/she is not connected with all the gardeners, builders and cleaner who get the contracts.
It would be better to come up with an alternative on the first meeting. I can research if there are well reputated administrators, but this only makes sense if we think we can win the majority vote on it. What do you all think about it?

There seems to be a wide variation in the success of communities. I agree that having a good administrator is key. I think the developer holds the votes for all the apartments that have not been completed on so may be hard to outvote if he has someone lined up for the job.

I think seeing if we can find someone recommended is a good idea - I put a post on the general board to see if anyone can recommend one in the area. If we do identify someone we'd like to propose I'd be inclined to talk to the developer - they may be perfectly happy about it.

I think it's reallly important that as many of us as possible get over for the first meeting. I understand that the developer retains the votes of the properties not sold and that they can maybe put themselves in the position where the have the proxy vote of those not there. We don't want anyone with vested interests effectively taking control.

2 weeks ago Maximo spoke to me about some posts on EOS. I was surprised as I did not know he read here. It is a public forum so he is entitled to read but that is one of the reasons why I have recently been more circumspect in my posts .

The committee was elected to do a job and it is getting on with it. There is a lot going on but I prefer to report when things are done rather than when we plan to do them. Progress on so many issues is slow so there is not a lot to report but here is an update on some issues:

The Road. As previously reported there is no immediate prospect of progress with the road beside the railway. My understanding is that the widening of the road at the back that was done before Christmas was carried out so that we can continue to use the back entrance when they start the work on the road down the valley to join Carvajal Avenue beside the Marie Luz building. We had been told that work on this road was to commence later this year. Perla has said that because of the deal done with the town hall whereby the developer paid 300,000€ to the town hall as a contribution towards the cost of this road in return for the re-issuing of the licence for Phase 3 construction work will actually commence next week! Due to the source of this information we will have to wait and see if it is true.

Ramps \ Warning signs etc. We have been promised a meeting with Ana Mula. The issue of road safety and proper provision for pedestrians is one of the items on our list of things to discuss with her. No action will be taken until we know what the town hall proposes.

Cabin. As you know this was supplied by our maintenance company. We refused to pay for it – saying we wanted a bigger one for the same price. He hasn’t changed it or asked for his money so we are currently doing nothing. If the “Tardis” is free we will keep it and do it up but we are waiting for Raphael to make the next move.

Post Boxes. We have identified a suitable site to build these beside the cabin against the gable wall of block 2. We also plan to put a map on this wall showing where each block is located. Nothing is being done at present because we don’t have the funds.

Arrohabitatge. We received a letter saying they were going to sue us for some of the conditions we made for us to enter into a federation with Phase 2. It is a bit illogical as we didn’t enter into a federation but it is time consuming dealing with these things and to be sure we have to involve our lawyer.

Gestagua. We have ongoing issues with them. For example they cut off the cleaner’s water supply when they installed the meters. They also say that our distribution system is wrong and have demanded we change it. We have said that system was approved before the contract was signed so we are not responsible for any changes that are required. In any event we don’t have a plan of the layout so could not do what they ask. We have asked for a plan of the layout so that we can check once and for all that Arrohabitatge is no longer stealing our water. Our 1st community water bill was extremely high. They are billing us for water before we contracted for it and we are trying to get this sorted out. It did however prompt us to look for leaks. One we identified and fixed a couple of weeks ago. We think there are numerous minor leaks in the irrigation system but they will cost money we currently don’t have to locate and fix.

Our Service Provider Agreements are currently under review. For obvious reasons I will report only on the outcome of this review.

Progress of Legal Claims against Arrohabitatge. The courts have accepted our case against the developer. This does not mean we have won. It will be long process! Our lawyer and Technical Architect were on site today to look at the erosion beside the lower swimming pool and block 6. They are to advise on whether this should be the subject of a separate claim or added to the existing one because remedial work is required urgently.

Progress of Legal claims against debtors. The first batch of these were signed some time ago and a further batch signed last weekend. I do not know exactly what is involved in the legal process but I will report when we actually get some money in.

I hope this information is helpful. I know I started off by saying I didn’t have a lot to report but as this has turned out to be rather long I am posting it on a dormant thread to leave the Community Matters thread free for discussion.

Grateful thanks for his update - vital for non-resident owners.

re cost of water used by the community. I think it is rather urgent that all leaks are located and fixed - if necessary, consider asking all owners for a 'one-off' contribution to help with this once it is properly costed. To do nothing due to a lack of funds is not really an option - we continue to pay for water which is leaking away as well as of the waste of  treated water.
