Well we cant be there either, so will probably ask Carol to represent us especially as she lives on the resort and has a greater understanding of issues.

There's a doct attached to the email we received so we can organise a proxy vote.

According to the Horizontal Property Act (art 16.2), as  President of Community of Owners, you are hereby invited to attend the Annual General Meeting of Community of Owner which will be held on 20th  February, 2009, at 16.0 p.m. first summons and at 16.30 p.m. second summons, at “El lago de la Torre Conventions CentreLa Torre Golf Resort, C/ Atún nº 18, Roldán , with the following agenda:

 

  1. Information about the organization of the Community of Owners, outline and operation of Community levels.
  2. Information about Annual Accounts and budget for the Community. Distribution of the budget according to the Statutes.
  3. Renew, if approval, of the Community representatives: President, Secretary- Administrator.
  4. Any other business.

 

Cause the topic to be treated are considered very important, we request your attendance. In the case you are not be able to attend, please delegate your vote in any other representative by using the delegation form below.

Hi All,

I think it's a great help that we have people like Noreen coming in to give us info about the community set up, and am not quite so worried about this anymore as I think it is more for information purposes than anything else, but I hope we find out promptly what that information is.

Carol would have been just about everyones choice for putting our votes in but unfortunately, in this instance I think we need someone from the Naranjos apartments to represent us ( Anyone resident in the Naranjos apartments?) and someone from the Jardines to represent them.

I'm guessing that the penthouses will be at a separate meeting, but then again only blocks 1 - 5 have their COH, so who knows?

Wiredout, the email that Phil has is for the Naranjos meeting, the Jardines one is at 9.30 in the morning

Hi all

The Agenda for the General Meeting is published in the notification and the meeting will no doubt only stick to the published agenda. There is Any other business but not sure if we can raise ? issues or if they will have already been raised, but :

Within the pages of the "Articles of the Association" (Remember the 19 page (2 x A5 per page) Handout we were all given on signing our Deeeds and never read) this states all about the meetings and all the rules etc even that the committee only needs to give you 7 days notice. (it also states rules about Any other business)

Myself and My Wife Lesley are permanant residents in Jardine 4 and would hate to see votes wasted? so will take your proxy votes "Jardines De Alhama Only"

In this instance we will probably only be voting on first three items of agenda President, Secretary, and Administrator all of which are in place already.

If you wish us to cast your vote please sign your proxy and scan then e-mail to me sonatigh@hotmail.com

I will then hand them to the appropriate person to ensure we can cast your votes if required .

I will state that if i do recieve requests to cast votes by proxy then all votes will be at my descretion in other words it will not be possible to vote differently for all the proxys? think that makes sense.

Also this is a one off? I am not seeking to be Elected I came here for a quite life?

Hi Martyn/June & All

I agree with your comments, I am aware of someone from the Naranjos Jardins that will be in the resort at the time of the meeting so I will contact them to see if they would be available to attend and would be prepared to cast votes for those on Naranjose that would like them to. I will let you all know the outcome.

I too received my community form the other day for the jardin 3, wont be able to attend but would be happy to offer my vote to anybody of sound mind that wishes to come forward as our rep

lets hope its a all for one and one for all agreement?? we dont want to many cooks to spoil the broth

I found a document on the La Torre Community web page.  It gives a very good breakdown and clear explantion of how the community charges have been made up at La Torre.  I assume this method will also apply to us on Condado. 

I've not made enough posts to be able to add the link but if you go to     ltgr.  es   ( dont copy and paste this address as i had to add spaces so that I can post this message!)  the link is at the botton of the page " Explanation of  Community Fees"

This might give those who are attending the meeting some information on the calculation of the fees.

If this document is of any use perhaps someone who can post links can put the correct link on.

We are out with the kids as its half term and plan to attend the meeting.

Does anyone know what the difference is between the 1st summons and the 2nd summons?

Also we have just been reading the general articles of association (rules given to us on completion) and it says that subsequent AGM's will be held either November or December each year

The difference between the 1st & 2nd summons -

At the 1st time, there has to be a very large proportion of owners in attendance for the meeting to begin. I am not 100% sure but something is niggling to say that it is something like 75% have to be there.

That will probably never happen.

At the time of the 2nd summons, there can be however many people in attendance & the meeting will proceed.

To answer another point further down in the thread, you may raise points/issues in the AOB section but you will not be allowed to vote to make decisions on them as they are not formally listed in the agenda.

Another point raised on this thread is the backdating of community fees - My understanding is that the developer is responsible for all running costs, gardens, pools etc until such a time as the community is formally set up. I would recommend that someone sends a PM to Maria de Castro (Spanish solicitor) who helps many EOS members on the general forum. Maria will clarify that point for you.

I am happy to help & hope you don't think I am interfering in something that is none of my business but having been through all this last year, I hope that I can answer some of your concerns. If you want me to butt out, just say so!

One last point - Be prepared for a long meeting. Our shortest is 4 hours & the longest is 5 & 1/4. Make sure you bring a drink with you.

What you are saying sounds like it is in par with Hacienda , First meeting June 08, back dated community charge to feb 08 and the next meeting is being held March 09.

Noreen I am sure no one thinks you are interfering, its nice to hear constructive imput from 'outsiders' .

Mike , Dawn exactly what we had  discovered about community charges. Quite backdated in real terms and not sure Hab Cert makes too much difference, as services supplied despite Hab Cert not delivered. Completion seemed to be the key but we wait to see, lets hope people get that clarified, because some people waited a while. Fortunately at these phases we are all apartments so fees expect to be less than a villa.

Regardless- and due to jury service cant visit at half term (gulp)- still happy with purchase.

Hi All,

Just to let you know that Martyn has decided to go over for the meeting and will be happy to represent Naranjos, he does intend to  go to both meetings to gather as much information as possible, so anyone that would like him to take a proxy vote, if you fill in your delegation form, scan and email it to us.( PM us for email address )

Does anyone know if we have to let RPM know how many proxies he will be taking, or  does he just turn up with them?

Also, if you have specific questions that you would like bought up, if the opportunity arises, please either post or pm in plenty of time for Martyn to collate all the information

Just noticed on our delegation form that at the top it states our meeting is at 16.00 & 16.30, but at the bottom where you sign it states 9.30 & 10.00?

PS Carol, you'd better get Louise to put a lasagne in the oven for him for Thursday night

I WOULD BE INTERESTED IN GOING TO THE MEETING,AS I SPEND 3 WEEKS OUT OF 6 IN CONDADO, AND AM INTERESTED AS TO WHAT IS GOING ON

You dont have to be elected to attend meeting you must be an owner or represen t an owner (! person per property

For proxy the proxy must arrive at the meeting with the owners signed form giving them the proxy then sign the register for each property he/ she is representing

So in answer to your questions take the form with you

For info of others Any other business can only be raised at the meting and can not be voted on

Also be prepared for a long meeting (Mainly in Spanish) and take drinks with you and food if you need it
