In reply to Rene35 and Rig's post about the garage keys I have just returned from Spain and got my garage key from the promoter's office yesterday. You get a magnetic plastic key which you insert in the pilar at the side to the entrance of the garage this is completely free. I was not told anything about the €50 key but this I believe is for the remote controled key which from my understanding was not supposed to be standard spec in this development but is being offered as an optional extra as some people have requested it. For me the free plastic key is more then adequate as it does the same job as the remote and only takes a second or so more to operate! With regards to westport's comment on Centauro I have used them three times now with no problems this time I got a free upgrade from a Ford Fusion to a New VW Golf TDi.

Well done lads it was a funny meeting indeed !!!!!!!!!!!

I just wanted to know was the €300 that we gave for the community at the completion meeting ever lodged , as I heard at the meeting that a lot of this money was not put into the account for the community. I signed on the 4th of Oct so I was wondering when do we start paying into the community account. As now thanks to Geriom 99 I have the account numbers.

Also I dont know if people are aware but you have to call to the developers office to get your garage key.

Sorry but i did not buy of the developer we are buying of a private sale as the builder in feburary would not let me take over there contract .When i do complete when? i will name a shame some people a bit like the car company.If some people think they had a bad  time with the builder mine has been so very bad.Last week on thursday we where told by our lawers we would have to pay the tax for the people we  where buying of as a reatainer in case the did not pay there tax 24 hrs before completing this was E3,500 .Where do people come up with this in 24hrs.We told them we would be pulling out even when the furniture was being del the next day .so everythink was cancelled on friday, and this was nothing to what else whent on and i dont know what next week will bring.bye irene/peter

Hi Irene I'm sorry you seem to be having such a tough time. If the person you are buying from is a non resident it is the law that part of the proceeds is retained to ensure that they pay the tax. But it comes out of the money you are already paying and you should not be asked to pay it. It sounds like you to have a poor lawyer but I would advise refusing to pay this money even if causes a delay on completion - you don't owe it and it will be very difficult to get it back.

From my understanding when you buy a resale (that is from someone who has already completed & who is not a resident of Spain) 5% of the purchase price has to be retained for the tax authorities and 95% goes to the seller. This is so that the person you are buying from does not run off without paying the capital gains tax. It should not make a difference to the buyer as they will only pay in total the agreed sale price.

Irene that is also the practice in Spain and what they should do. In my case I had to bring seperate drafts - 1 each for the seller, seller's lawyer and estate agent but the total added up to the total already agreed.

They asked us for this as extra on thursday on top of what we payed in july we payed 14% for our legal fees and buying costs and on wednesday they asked for E660 this was payed on wednesday that was fine as you expect a little more just have to see whatsnext.we even payed for the storage in august and with fees and vat that was 7,200  bye irene/peter

Hi All

Just to let you know my friend Leah who speaks fluent spanish was up at my apartment today and was talking to the security gaurd who said that the developer has let him go and he is starting a new job somewhere else at the end of the month,  So what will be the situtation be with security on Don Juan?

Surely if we are in charge of the community it is down to us to decide if the security guard stays or not, not the developer.

Hi Eoin,
I met Leah (who did a great job translating) and I know what the guard says. Last month we had an identical situation. The guard saying his contract ended, the promoter stating that they wouldn't pay him and he is still there. I can't spell it out because everyone can read here, but let's say so far we won. There are still a hundred fridges, cooking plates and washing machines in Don Juan II. Rest assured we are very aware of the situation.

Hi Westport,

The community were not paying the security guard the developer is and was, that was one of the questions at the meeting would Don Juan 1 community contribute to the payment of the security guard and they were told NO . Which I myself think that we need to look at security seriously. Because the security guard would not say he has another job at the end of the month if he was going to stay, he is a really nice man and not a liar, Maybe our community need to rethink the decision as a lot of us will not be there 50% of the time and with no security its wide open to all.

I see your point Max that they will not leave Don juan 2 with no security but I do feel that the developer is ruthless and could put up cameras for to watch don Juan 2 and not be bothered to watch Don Juan 1.

It would be such a shame to lose the security guard he is a really nice guy and did a good job. When I was there I used to see him walking round the site and checking everywhere. Its a bit of a gamble.

We are looking very seriously at security and will have proper proposals at the next meeting. We are just not prepared to pay for Tico, the security guy who Arrohabitatge hired (at a ridiculous hourly rate) and instructed to NEVER look at issues in DJ 1. He is only guarding the white goods in DJII, he is not properly insured and not up to the job as you can't do a 60 hour continous shift on your own. He has no cabin, no security cams to check and he is not allowed by the promoter to do the rounds. He does them because he is bored and Tico likes me (because I bring him coffee and talk to him a lot) so my garden is the most secure area of Don Juan but that's not his job.
At the next meeting we will have a proper discussion about it with proposals, cost estimates etc. Meanwhile we will manage. Rest assured although I can't spell it out.
And just for the record: I never called Tico a liar. He is struggling with his Spanish as he is a Romanian living here for a few years and he gets told a lot of lies by the developer. He is as confused about the whole situation as most of you, but I consider him a friend and will never cheat him.

So realistcally there is going to be no security on Don Juan 1  from the end of November till the next meeting which we don't even have a date for in January  and then after that meeting you are probably talking another month to set up the new security,

I think this is mad!!!!
