Has anyone had or heard when the habitacion licences will be issued for Phase 3?

Has there been any progress on habitation licenses for phases 1 to 3? I am also wondering how many people closed without the habitation license and if there are any issues with services such as water, electricity, garbage collection etc as a result.

Several English people and many Spanish have completed and are now enjoying their new properties. The only issues so far with water and electricity is that they are free! (Paid for by Peinsa until licences are granted.) A few more refuse bins are needed but there are plenty in the neighbourhood.

Gas cannot be connected without the licences but Peinsa have supplied 2 gas bottles per property for water heating - refill at your own expense.

At the end of the day it is an individual decision as to whether to complete or not, however, generally speaking, it seems to be the exception rather than the rule that licences are issued before completion.

Our solicitor has been in touch with Pulpi's Town Hall representatives to check the current status of the 1st occupation licence for our property on Phase 3.

Application submitted by Peinsa 30 May 08.
Although the current survey of the site shows no objections, there still are some minor infrastructure works to be completed by the developer and for the Town Hall to issue the required certificate. This should be in place in one month's time.

We've since spoken to him to ask if this is an optimistic or pessimistic month, he does not know what this minor infrastructure work is but would be suprised if Peinsa don't have the resources to get this done and checked by surveyors within 2 weeks (obviously a glass half full kind of person) - We'll see !!!.
He does not recommend we complete without the certificate.

We just wish the feedback we get from the girls in the office, who after all are the Peinsa representatives, told us the whole truth and not just keep saying the certificate may be today or tomorrow.

Does anyone have any further information.

Really useful posting - thanks.

Although I don't have an update, hopefully the posting will be seen by those yet to complete on phases 1-3 or who are waiting to be able to arrange connection of their services and either way push the builders to carry out the necessary work.

If your solicitor has not already it may be beneficial to e mail Penisa with the information you have been given, asking for their comments - making reference to the concern that representatives in their office are not either up to date with the true positon or alternatively are providing inaccurate information to buyers - neither of which is good.

Has anyone else been advised that an application for a habitation license, constitutes a legal completion on a property.


 We are trying to withdraw from our purchase on phase 2 which was due for completion in Feb 06 and have been told that we are unable to do so because  the habitation license has been applied for. We have been asking to withdraw for months and were initally advised by our solicitors that  we needed a renewed bankers guarantee. This has been applied for by the solicitors and also by ourselves by writing to Peinsa HQ direct. We had no replies and no renewed guarantees.

 The next thing we heard was the application for the habitation license and  told we were unable to withdraw since we were in a completion stage.

They are saying that we have therefore legally completed.

 Any feedback  on this would be really helpful, since like all the other comments noted, we are getting no where with anyone.
We are on the brink of engaging a London solicitor who specialises in Spanish property law  so all feedback gratefully received.

I am following this post closely like I would imagine everyone else is, loads of info and some good facts. How on earth can they say you have legally completed on your proprty if you have not signed for It ( As I would imagin you have not ). How long have you been trying to pull out of the deal, we were thinking of doing it but we found it hard to find a better place we could live in Spain so we bit the bullet and stuck in rightly or wrongly, at the moment we are well and trully fed up with the wait but we are starting to see the light. Hope you get what you want in the end, as we all deserve something for our wait good luck for the future john & louise hope you win.

i was told piensas stalling on the habitacion licences could be a tax dodge on their part for this financial period . bringing completion into another period maybe reducing their tax , cant argue with that if i were them

My solicitor has informed me today that Peinsa have stated the licences for the 1st 3 phases have now come through.  We are just waiting to see a copy sent by them. So good news for those waiting for the actual licences before completing.
