Recieved today from our lawyers who I have to say have always replied quickly to our questions and concerns:
Unfortunately things have changed since we last contacted. In effect, at that time construction works were suspended but we have been informed that have re started now and they are working very hard night and day to finish a.s.a.p. Of course they will not finish before the deadline, but if the delay in delivery is not too long, I am afraid we will have it difficult to get the contract cancelled and recover the money.
As I told you we have to take two different steps and it is very likely that both the developer and the bank refuse to pay and stall the matter until the First Occupation is granted. If you took them to court and the delay was short, the chances of winning the case would be little as many judges are considering a 6/8 months delay reasonable and not a reason for cancellation (for compensation at best).
