We cancelled our contract last March/April and had to wait till March this year to receive our money back, we also received interest and due to the exchange rate moving in our favour turned a nice profit even after paying our lawyer. We used Lawyers of Spain and at times felt they were not acting in our interest. We were proved wrong as they did eventually get our money back. The developer is the one holding onto the money, especially due to the credit crunch.

Our apartment was going to be phase 4 block 2 but as so late we asked for our contract to be cancelled. We have just had news from our bank in Spain that our deposit + interest has been refunded this morning. We originally started asking for our money back over a year ago. Initially they offered just the money or wait an indefinite time before claiming money + interest. They missed the deadline they had given us and feared we would have to goto court. We used Lawyers of Spain.

As our apartment in Phase 4 Block 2 is alledgedly complete we are unable to claim on the bank guarantee as it is no longer valid!

When you say the license will not be issued for a year at least, does this include blocks 1-3? or do you mean the last block of phase 4?

A previous post had said the developer will not release any blocks till all of phase 4 was complete.

If the last of phase 4 will not be ready till 2009, what about the club house, driving range & golf course?

Hi,

We are buying on phase 4 block 2 and as most of you know blocks 1-3 have a completion certificate from the architects "Scarper & Leggit PLC"

Just got off the phone to our lawyer regarding the habitation license, she said that the documentation the town hall has received from Arenal is the prelimanary paperwork and not a full application, therefore was unable to provide me with any idea at all as to when the apartment can be handed over.

Has anyone heard differently?

The bank own the empty units, some of which will stay empty a long time. If you suppose the bank own half of the unsold units, will they be paying their 50% for the running of the site? Worst case scenario, if you were the only person in your block and all the others were still owned by the bank would you be paying the up keep for the entire block?
