As a buyer of an apartment in the Los Corales development in Estepona we have just been informed OVP have kept 50% of the deposit we paid 5 years ago and despite previous denials form them, it seems they have had contractual dealings on this site via Berkeley Properties owned by the assumed late Sean Woodhall.
The bottom line is they cannot pay the developer the deposit balance therefore the developer now wants to sell to us direct at ''build cost''. Great in principle but those taking a mortgage will be left having to fund additional deposit monies.
We are told if we do not complete inside 2-3 weeks the developer will cite breach of contract, keep our deposit, and resell our apartment. Given the delays and problems are certainly not of our making I find the developers stance outrageous!
I have been trying to speak to my lawyer; GVA, this week and they are not responding at all all of which makes me feel there is a much larger conspiracy here!
My advice to anyone dealing with OVP is get out if you can and for those considering dealing with them- DONT!!
