We met with a solicitor who obtained a certificate detailing when the building work was suspended by the Town Hall (Jan 2008). This has been used in the process of terminating our contract. We are now awaiting a 40 day period for the bank guarantee company to respond. We have been advised that if they don't cancel the contract and return our deposit we will have to go to court.

I hope we'll get the deposit back without court action, we are perfectly in the right to cancel under the terms of the contract (i.e. no delivery before May 2008 - Balcon de Alcaucin Phase 1).

We recently appointed a spanish solicitor to obtain our deposits back under the bank guarantee. We understand he is unable to obtain a 'certificate' from the Alcaucin Town Hall in order to start proceedings. This is due to the ongoing legal dealings with the arrest of the Mayor!.  At this time I don't have info about the type of certificate required.

Hence we are blocked. I have a meeting later this month (19th) with him when I hope to find out more information.
