 Hi there, my ex wife and I put a deposit on a property in Calas del pinar in August 2006 and it was to be completed in december 2007. After all the delays we became worried and on this forum discovered that we had not received a bank Guarantee and it seemed our Solicitor was totally in the pocket of Peinsa. We agreed to numerous extensions and eventually agrreed to a new date of completion for feb 2009 which was well over a year later than agreed. When nothing emerged in Feb 2009 we cancelled our contract and sought the refund of our deposit as we now had received a bank guarantee. We cahanged Lawyers only to have a worse experience with Maria De castro. Our property was finally completed in 2011 but by then my wife and I had split up and 5 years after we had thought we had found our dream home we now could not afford it because of our new circumstances.

I have recently been to Court and have lost the case as they do not deem a 2 year delay as an essential breach of Contract which to me is insane. I am of course appealing the case and wish to know if anyone can offer me advise or information about other people with similar experiences. Even if I wanted to i could not now proceed with the purchase and I am now down approx 100,000 euro..

Is anyone watre of any sucessful appeals of people who have recieved their deposits refunded.

Can anyone advise if anybody has completed on Phase 9 of the development. I have withdrwan and I am  in the process of a legal action using maria De castro as  I could not wait any longer.

People who have a B.G are covered by the Bank if the completion date on the contract is not honoured. Completion date means all licences must be provoided. I am also advised that a B.G. can not have an expiry date in law and must be honoured. It is a different case if someone did not have a B.G at all. I am on phase 9 and I know it will not be complete in February as per New Contract so I am looking for my deposit back even though my Guarantee will expire in a weeks time. I agree that we should band together with a common aim particularily if you are on a phase that has no hope of completion. Maria De castro seems to be a good solicitor but is expensive so if a group get together we may reduce the costs and lose less. The awy we all have been treated by Peinsa and the various solicitors is a disgrace and I can not stand any more of it at this stage. Nearly 2 teasrs of heartache and lies.

Yes Sue you are correct it was AMBA sun that led me up the garden path and to date I have never even met the solicitor as I have been dealing with the Law assistant. I have listened as Peinsa  bee1ng described as an absolute brilliant builder and that I had nothing to worry about.

I hav tried on a continuos basis to enduce a reply from Peinsa with little or no success. Told I would have to pay for BG and a litany of excuses that have made me more than concerned.
