Thank you so much everyone for all the advise I have received it is very much appreciated, I was totally confused about CGT and the 3% retention the tax office hold, when I sold my previous holiday home in Spain the lawyer never contacted us about the 3% Spain were holding, we did pay capital gains in the UK and fortunately had all the receipts of payment to give to our accountant which UK tax office accepted.   Now I understand, I have heard stories that you cannot get the 3% returned from the tax office here, we are selling again and buying another holiday home, there will be no profit on the house being sold, am I right I will have to keep my fingers crossed to get the 3% retention returned

We bought our house in 2009 for 100.000 euro and we are selling it for 90.000 euro, I have been told the tax office will insist I pay 21% of the sale price for Capital Gains tax but there is no gain.   I am buying another house in Spain, I am not resident I live in UK, house is holiday home only, can anyone advise me please?

Thank you so much for taking the time to reply, you are right of course she should go to a lawyer, the problem here is what they cost, sadly she does not have the money to instruct a lawyer and to make matters worse the lady died last night, so now my friend has got funeral expenses too..

Thank you for your reply, I have caused confusion, there are two issues

My friend the beneficiary of the mans will does not speak English and she asked me to help her  I contacted, friends,  UK Pension office all banks, insurance companies etc., she told me the man had told heer there was an account where a huge sum  the bank where the huge sum was paid into earlier this year, did not reply when I contacted them 4 years ago, my friend went to the bank who told her the funds had been returned to the solicitors, I am assuming this money was a bond or something.   The bank insisted you went to a solicitor and provide copies of all documents which she did and has now ran up a bill of £400 and the bank will not communicate with her despite them being given all the documents!

2nd issue, this week the Spanish Solicitor who prepared the will for the Englishman called my friend and told her THE MANS  daughter is now disputing the will, 4 years after his death, it seems odd that huge sum arrived and the daughter has come out of the woodwork, can his daughter dispute the will?   The fact that the money is frozen is not an issue my friend understands but now the daughter disputing the will is causing my friend many headaches, naturally she has spent some of the money he left her.

The wife has Altzheimers, her son with first marriage never contacts, I found one letter from him to the man asking him to ensure the solicitor has his address when his mother dies, nice guy egh, I have tried contacting him to give him an update on his mum and he ignores my correspondence and photos

The main query is can she get the will reversed in her favour?   I met the man and he was alert and on the ball.
