As far as I know, an alternative to lifeguards is for the pools to be fenced and locked. All owners should have a key and be responsible for their own and their family's use. This is being done on our development this year to comply with the rules. Again in our case, the developer set up the Community and appointed an Administrator before all the units were sold but after they had finished all the building works and left the site.

I would have thought there should be some sort of handover by the developer and the Community set up before they leave the site. 

An important point regarding the pools is that fencing is obviously cheaper in the long term than hiring lifeguards for the summer months, but it may be left to the community to decide on and to pay for, if the developer doesn't fence them in. I understand that the developer is awaiting the licence for the pools from the Town Hall.

When we completed on another property a few years ago we thought we wouldn't need buildings insurance as there is some cover for this in the management fees but it doesn't cover the individual apartments in the same way as it does in the UK.  Buildings and contents insurance is available from the bank you have the mortgage with, sometimes they insist on you taking theirs, but otherwise it's a good idea to get comparisons.

Hi Daniela,
You probably have an answer to your question by now but I believe your lawyer is correct because you have bought the Private Purchase Contract from the Investor which has the original price to the developer which you will complete on.  The difference is paid to the investor who has gained from the investment.  The IVA is due on the purchase price and the Investor gets back the IVA paid with the deposit.
