Thank your posting the photos. It has had progressed since I last saw it at the beginning of august. For all those frustrated buyers like me waiting for the road to be completed and the license to be granted for the rest of the development, it is great to see progress!!1

Hi everyone

Steve here buying in block 8. I was holidaying in benalmadena last week and popped down to duquesa last monday 4th. My first visit in two years!!. Major progress!!!

I have posted four photos. One is of the road running below block 8 and the other three and in and around the development to show people how well it looks.

I was very impressed with the development and things have moved on. I visited my solicitor in sabbi on monday before I went to the development. The developer told him that they will progress getting the habitation licence for the remainder of phase 1 end aug / early september.

Here's my observations from last monday:

1. The place looks fantastic. I haven't  seen a better development and the location is excellent...I've been stuck up in the hills around benalmedena without a car for 9 days!...getting food and travelling has been a real pain in the bum...in duquesa everything is 5 minutes walk....it makes a real difference.

2. The road photo I posted doesn't show it has moved on much from earlier photos...there was no one working on the roads and a just a handful of plasterers were clocking off from phase 2 and pahse 3 (maybe 4) couldn't tell.

3. There was no construction activity on the other phases that I could see.

4. The developer obviously needs to finish the roads before any chance of the license. That is going to take alot of effort from a big squad of guys to complete by the end of the month...I don't see it happening. I wonder whether August is a go slow month in the building trade because of the heat / spanish holdays?

5. I pushed my completion expectation out to easter next year!!!. We'll have to wait and see.

can anybody advise....

I bought out the off plan purchaser of an apartment in block 8 in August 2006. With the ongoing saga of the road / completing other phases etc. I don't know when I will complete. My purchase contract constructed by my lawyer basically took over all the rights and obligations of the off plan purchaser. I paid over what the off plan purchaser had paid to Arenal plus a small "profit".

I have a copy of the bank guarantee made out in the names of the original off plan purchasers. I have been re-assessing my options lately in light of the exchange rate, cost of borrowing etc. I really don't want to walk away but I thought I'd ask my solicitor if it was possible to call in the bank guarantee and possibly get compensation.

My solicitor talked to the developer yesterday and it appears that for me:

1. I can't call in the bank guarantee because I am not the original purchaser (even though I thought my purchase contract took over all rights and obligations).

2. The Developer said that compensation was not an option.

3. The Developer has kindly agreed to send my solicitor written acknowledgment that I am now the owner of the apartment which makes me think why didn't my solicitor chase that two years ago!

Has anybody got experience of this...i.e. if you called in the guarantee were you the original purchaser or were you in the same position as me?

P.S the Developer bleated on about the road, and how inflexible the town hall is being by not agreeing to the habitation license for the rest of Phase 1. As for completion dates fro the road...you got it...not a dicky bird.

I am buying a furniture package from villapac. They want final payment 90 days in advance of installation. I am happy to do this. They are very accommodating. I am in block 8...I have put the installation date back numerous times.

I wouldn't be alramed with the comapny asking for final payment in advance.

are you in living in Duquesa...in one of the released blocks?...Is there a lot of effort going into road at the moment...a squad or workmen beavering away or a couple of guys just plodding along?
