We seem to have been on this forum for years! Has anyone heard from their lawyers with updates recently,  I am with DVA and they are not replying to any emails i send them, if someone could please let me know if they are still in business.

I am interested in hearing more about joining forces, however we have not been contacted by the developers but we have since changed our telephone number so this may be the reason. Have you any idea about costs involved if we join forces. I know one of the other forum users looked into claiming as a group last year but the costs seemed rather high this may have changed with the recentpost from Maria.

I have received this from DVA:

The bank guarantees were required but never handed over for you or any of the purchasers in this project. The developer’s company went into legal investigation and the legal administrator acting appointment by the Court did not issue these either. Let me point out that this is the developer’s company obligation to grant and hand over the bank guarantees and there is nothing we can do more than requesting them to fulfil this obligation as we did in several occasions.

 

However, you only decided to pull out of the contract once the project was ready for delivery. By then, the bank guarantee is expired so you would have not been able to use them anyhow. This is why I informed you that these are expired.

 

If you would decide to sue the developer’s company the lack of bank guarantees could of course be an argument for the resolution as it is their legal and contractual obligation to hand them over. However, you already have the resolution of the contract accepted by the developer. The problem is that said company does not have the money to refund you.

 

Your choices are:

 

- To wait until they have funds enough to refund you with the risk of the eventual bankruptcy of the company.

- Complete the purchase.

- Sue the developer’s company trying to obtain from the court the embargo and execution of some properties to get paid. This is possible but involves litigation costs and it is a slow process.

I have had this from R Bright but she is unable to post it.

I've tried to post a reply to the aureus updates but with no apparent success.  Could you please do it for me.  My reply is as follows:
 
Hi all
I agree with Irish Iris that we need to set up an action group because I also feel that we are the victims of outright lies and deceit.  I requested a copy of my contract and the bank guarantee from my lawyers, and this is their reply:
"Dear Mrs Bright
Please find attached copy of your purchase private contract as requested.
The developer's company never fulfilled the obligation of handing over the bank guarantees.  However, these expire since the Certificate of End of Building is granted.
The information that I have given you is only what the developer has informed me.  My recommendation is that you complete the purchase as having a credit against a company that may not be able to pay ever is very insecure.  Of course, its your decision to continue waiting or to complete the purchase."
It seems to me there may never have been bank guarantees in the first place. I am going to ask my lawyer to ask the developer company to locate the so called expired bank guarantee and forward it on to me.  It also appears to me that my lawyer may have been grossly negligent in not demanding that the bank guarantee be handed over to her in order to ensure that my interests were being protected at least whilst the building was under construction.  Many of us also cancelled  our contracts before the expiry date of the bank guarantees (if they existed that is), and how does that affect our legal right to a refund?  We all need urgent independent legal advice which sadly we won't get from our spanish lawyers.
 I get the feeling that we have all been grossly misled by everyone in this nightmare.  We need to form an action group as a matter of urgency and meet up in a central location and perhaps as a group seek legal advice here.  I'm  looking for litigation lawyers with expertise in spanish property law for initial advice but how long this will take I don't know.  I am in touch with smithl by private e-mail and have sent 3 private e-mails to Irish Iris but have never received a reply.
I will keep you posted with regard to the saga of the bank guarantee.
