Thanks for your replies.

 

I do have a guarantee for the initial deposit, however they did not supply one for the stage payments...even though we chased many times.

 

Our legal claim is currently lodged with the court in Madrid, and we hope to attend a creditors meeting soon to see what is happening...

 

It would be especially nice to hear from other Tasa buyers

Hi

Having paid a deposit on a property in Spain (off-plan), I am now in the middle of a legal battle to recover my deposit as a result of the builder stopping work on the development, and subsequently going into administration.

I am looking to hear from people in a similar situation - I feel there are lots of you out there and if we get together, maybe we can get some action and support from  - well I am going to try my local MP and the national press.

 

Basically I think it is scandalous that we have guarantees that our money is safe, but when we try to get it back it is a big legal issue, costing money, time and probably heartache for many.  I am hoping the power of many voices will help us get heard.

We bought an apartment in 2006 from Tasa on the costa esuri development. 

This was supposed to complete in April 2008.  In  October 2008 building work stopped.  In total we paid £43,000  including legal fees we have paid in exccess of £50,000.  We have been suing since June last year, and this week were told Tasa is under court administration and we are now a creditor.

Does anyone else have experience of this...

Our solicitor want's us to pay to attend the creditors meeting...is this a lost cause?  We dont want to spend more money if the reality is that we will not gert any money back.

Furthermore, does anyone have insight into the bank guarantees which are supposed to protect out money...ours ran out...should this not be automatically extended by the banks where property is not complete.  Why does the spanish law require a bank guarantee if they dont guarantee anything.

 

Are there any other tasa buyers out there who we could talk to...

 

any help or advice is very much appreciated
