Hi Paul

Could you be more explicit, what block and floor was the apartment on and how did the burglars get in? What time was the break-in, was the security guard on duty?

As already suggested at a community meeting the ground floor is open to anybody to enter the apartments from the back of the buildings, by jumping the gound floor walls of any apartment block and once in the blocks they can enter the garages, storerooms and the whole block and suggested grills should be installed in groundfloor corridors.

Nel and the Builders were quite dismissive of this idea and said at the community meeting that to put grills up along the ground floor corridors would alter the facade of the building (whoops, it's at the back of the building) and then said it was a fire risk. By Nel's and the Builders rendition of a fire risk, means that 80% of all Spanish built apartments are a fire risk. Don't think so, just their excuse not to rectify the planning mistake to safeguard the building! They appear to forget/dismissive that we are more at risk from violent burglars than a fire.

Well considering the numerous fire escape routes that are open, i.e. the main front door to apartments, open stair cases, garage, groundfloor residents where the grills would be placed, would obviously escape through the front of their apartments, the garden. However, Nel and the builders could always get advice from the fire department and provide the written proof of the Fire Department statements to the community of owners and/or ask the architect of the apartment block opposite, how they managed to secure the building and also cover any fire risk!! Sorry but Nel and the builders are ducking this extremely important community of owners safety issue and we need answers!

All in all, this is a 'burglars delight', planning error that needs to be rectified to safeguard the community.

The groundfloor back of apartments should have grills the whole length of the corridor, thereby creating a safety barrier for the whole block stopping anyone entering through the groundfloor back stairwell giving them access to storerooms and garages. I personally am very nervous going into the garage alone at anytime day or night, because I am fully aware that any unauthorised person could easily enter the building by jumping the back groundfloor wall. A good guide for Nel and the builders is to study the apartment blocks opposite Oasis, their corridors on the ground floor are completely enclosed. 

Who needs to ring an apartment block doorbell with a video camera, when they can jump the wall beside the main front door and enter the building without being seen. Nel is fully aware that people jump these groundfloor walls as we have told her on several occasions that holiday makers and rentals in our block enter this way, mostly early hours in the morning when they have arrived home and their partners are already in their rented apartment but are not anwering the main door bell.

The flimsy wire fencing around the whole of Oasis is the weakest and cheapest and is not the quality of one used to safeguard any complex. I thought when we bought the apartment this fence would be replaced with strong burglar proof fencing! This is a fault made and ignored by the builders and clearly needs to be discussed in the future community meetings.

I would like to hear any suggestions to safeguarding Oasis from any other owners.

President must be an owner in the community!

Dear ?

I wrote to the eyeonspain solicitor (free advice to registered forum posters) to confirm, that, which I already knew to be law, when we were at the community meeting in March 08'. However, as none of us 5 owners wanted to take on the role of president I accepted the situation as it was on that day. 

However, the administrator and the promoter are fully aware of the law, (not sure if Nel is aware), that it is illegal for anyone to act as president who is NOT an owner and part of the community. This means, that Nel's role as president is non-existant and could possibly create hiccups if we needed her to act legally on behalf of the community. More importantly, she has no sway within the community at all, in fact she is a sales person only acting for the promoters. What bothers me is that the administrator who should be above the law and legally advising the president/vice president and the community, appears to be economical with his legal advice for the community. Maybe that is why the undated MINUTES mentioned Nel as the president but was not signed by her.

Also, it is law that the minutes should be signed and agreed by the president within 10 days of a community meeting! I doubt these minutes are legal!  I am also concerned that after writing to the administrator three times requesting a user name and password to be able to enter his website for details on Oasis as promised at the community meeting, he has chosen to ignore my requests. I think that eyeonspain give an excellent service for their forum bloggers and please feel free to check the advice I freely received, from one of their lawyers as mentioned below. Her reply is short and sweet, but then I only wanted confirmation of what I already knew. You may already be aware of the above, but I thought I would mention it anyway.

We are a new community and do not have a president yet, but the sales person for the promoter's is acting as president until our next meeting in September, which I understand is illegal and should be a community owner.  ANSWER Correct.

As I am unable to add web addresses until I have made ten posts on this site, and this is my tenth, please for your own benefit, assuming I am allowed to add the web address on my next thread, please read and absorb for your own benefit the Horizontal Laws of Spain which apply to all owners, their president and administrators.

Unfortunately, lack of knowledge by owners creates a weakness which can easily by abused even by mistake, when dealing with presidents and administrators, who fail to follow Spain's laws/rules. To be forewarned is to be forearmed and creates a better community understanding for all.
