Hello could anyone advise,we bought a villa on rustic land 10 years ago the developer told us the other plots will have villas on when sold, with agreed designs submitted to the municipality  .Because of the recession it appears the developer has sold these plots possibly back to the farmer , and there will be some industrial buisness instead i.e a chicken or pig farm.Can we ask the developer to pay us back? as we bought in good  faith on the information provided that we will have a home in peace and  beauty, but now will become a place of noise and smells.

 

Also we had a ten year build guarantee still have one year left  our cieling has de laminated they want us to pay for the repairs and our insurance broker with the bank  wont pay either .We also seem to be paying very high rates for rustic land we have no roads to our home , just camino no lighting no refuse bins no post boxes.

 

Our water is provided by a well,  we pay the developer for  this water ,we have no main pipe underground as its broken and they have put a pipe above ground across neighbouring land to provide us with water we have asked for them to fix but ignore our request.

Buenas Dias guys

Apologies have not been on forums for a while, thought I should put a  post on my outcome of our dilema .We did get our first licence of occupation please note its called a FLO .We achieved this by holding back a portion of the monnies owed,  RIGHT UPTIL THE SIGNING AT THE NOTARY so while we were due to sign an inspector from the council was on site the same day .

The builder had to even put a fire door on the basement level a solar panel, and a safety hand rail on the rear steps, all this was done on that same day so we would hand all the money over on the signing.

So do not make an idle threat to your builders stick to it , show them you mean buisness,for those who handed all their money up front then you have no trump cards I am afraid.(  I still would not sign without one.)I would want to know my house is legal and that FLO will confirm this, if the council have issued that then you know they except this is a legal property.And your house is safe to live in.

We have a neighbour a year on still does not have his licence, and can not do any other build work .Also maybe a lawyer can confirm this as I am  not sure, if its the law all over regions but in ours Murcia,a builder must provide a solar panel for hot water this was put in place in 2007(I think) unless stated different in the contract as some builders will put the cost to you.

I also have another suggestion, always make sure the councils have your land marked out properly you can go on cartomur.es to check this for the murcia region  as the council does take aerial photos of your house, and also to see if your not building something without a licence and it will show you are not positioned on someone elses land and you do not in the future build on something that does not belong to you,as I understand everything now needs a licence.............last and final advise make sure your snagging list is checked by yourselves do not be rushed  too check take time on every finer detail, as later on you will find problems..Make sure you have that  10 yr guarantee and it covers EXACTLY WHAT .

I think we all can feel at times your builder is doing you a favour, this is not the case  it should be no different here, to when your in the UK you are paying good money and deserve what you pay for, if your not assertive you will be walked over.Good luck to all those still waiting to complete,and to all those looking to buy in Spain  check and check again, make sure what you are buying is 100 PER CENT LEGAL.do not be tempted by the rose tinted glasses

Hi can anyone advise I am looking to buy a car private sale but the car is in a deceased persons name the wife wants to sell but there is no will ,can I get in trouble if I buy this car. I am not a permanent resident been told all I need is NIE do have escrutia for house also is that enough for me to buy and should I have an agreemnet signed from her stating she has sold the car under these circumstances.Also should I pay the tax in my region or the sellers region as we live in different regions  apprently one car has already been sold at the traffico centre no questions asked??????confused what to do.

Hola Maria,

Thankyou for your replies we do not have the bank guarantee to cover all the money, and originally was only covered for half of the payment we made and that was dated to end this January we had to demand this it was not offered also as I understand a guarantee cannot or should not have a closure date on it.

Our situation is a bit more complexed I think,as the builder named us the promoter on the build licence without our permission,one would think that is not a problem but when it comes to the FLO we see it as a problem as we are the licence owners, so it is our responsibilty to obtain the FLO,and now the builder is stating that we have to sign the deeds so they can apply for the FLO this is apparently a local rule in Lorca.

So we are in a catch 22 situation we have asked our solicitor 2 weeks ago to demand a bank guarantee to cover all our monies and can you believe we have not heard a thing we are due to sign on the 23rd of this month.We are waiting for the bank  to confirm that they are aware there is no FLO in place as this mortgage has been organized (wait for it) by the builder.The bank is prepared to lend on the grounds they know of the builders reputation and the houses he builds.

Hola Maria,

Just also wanted to add if you cannot move into the house, seems a worthless task to sign the deeds as all we are doing is handing over money to the builder and getting nothing in return.

Logic says we should hang onto our money and we earn the interest while waiting for the FLO ,and what happens if you are signed up for a mortgage your paying monthly for a house that you cannot live in ,and where do we legally stand in payments for community services if the deeds are signed are we not liable for those costs ? paying for having your rubbish removed (em what rubbish ) this really does not seem a wise move to me ,especially as the Euro is so bad ,it seems like a no win situation for the purchaser,I seem to be using that phrase quite a bit in this forum.
