Hi Darren

I am really interested that you managed to get interest paid on your BG.  We are due to go over to Spain at the end of next week to collect the money held under our one and only BG and was told that no interest was payable and if we wanted any interest we would have to sue the builder for it.  Our BG is with Banco Popular, are there different rules for different guarantees does anyone know?  Our second stage payment unfortunately is not covered by a BG (47K) and presumably we will need to go down the Court route to stand any chance of receiving any money from that payment.

Any advice would be welcome.

Just to let you know after discovering what Aldea were up to via this forum.  I wrote to them demanding the return of our POA documents, our one and only BG plus any other paperwork or else we would turn up in person.  I also included a SAE.  Didn't really expect to hear anything but believe it or not they returned everything!!!!  Took about 3 weeks but we got it and now we are looking to start again with another solicitor and trying to go it alone to execute our first stage payment which is under bank guarantee with Banco Popular and can only be done on the expiry date on 1st October.

Are we missing something?  We are also with Aldea and just at the point of sacking them for not doing anything but had no idea that they were likely to go bust!  They also have our POA and original BG which we want back to pursue ourselves.  The rest of our money around 43k is not covered by a BG so we are likely to lose that.  Could you let me have the address, email and telephone numbers you are using as I was told that their office in Vera is now closed so no idea where to contact them now.  It sounds like we also need to cancel our POA that they hold also and as you say employ another solicitor to act for us.

Would be grateful for any assistance you are able to offer.

I've just attempted to sign the petition via gopetition as suggested.  I chose Europe, then Spain but there did not seem to be a relevant petition there.  What am I doing wrong?

Hi John

Not been on this site for a while.  Are you advocating Andersons as a good solicitor?  I think it's time we changed as nothing seems to get done with ours.  They are now telling us that even though we paid 1000 euros up front for legal services in March 2005 at the beginning of this debacle, they want a further 500 euros to execute a BG and a further 1000 euros when/if we receive the money under BG!  Has anyone else had this?  It is going to costs us 2,500 euros to get back some of the money that we gave to these solicitors in good faith to secure a villa for us which they haven't done and we will still be liable for the full legal fees!!!!  On top of all that we stand to lose another 39000 euros which is not covered by BG's.  I think it may be time to cut our loses and change.

Another one I heard of was PSI - anyone using them?

One more question - about how much does it cost to take Huma to court - anyone know?
