I have just read on another forum about someone winning there money back this week, the court case was won against the bank concerning the bank guarantee, not the developer.  Good news for those thinking of going along the same route if you have a bank guarantee?  Are there any others who have also got there money back?  We also dont want to complete.
The judge said there is no LFO thru Administrative Silence Rule because the building licence is 'revoked'.

I read this and many other forums regularly (although I do not post much) and am one who hasn't completed yet on La Reserva.   I am not ashamed to admit we are still unsure what to do for the best, so am always interested to read all comments and advice from both sides.

To be honest I am very dismayed at the personal attacks and suspicions aimed at mr. c, and do not understand why he deserves this.  I would appreciate any comments he has to make from his experience and have been interested to read his link.  Kenny and Dan, please be a little more tolerant to other people as there are those of us who have not completed and would like to listen/learn from others besides yourselves.

My thanks to maddy.hall and seabury4 for their helpful pm replies/info.

Much appreciated.

Have now discovered that when a developer puts in an 'illegal clause' that completion is when the Architect issues his End of Works certificate and  you sign the contract, then that is it.  You've burned your bridges.

It is regarded as an illegal clause because it goes against the law that states completion is when the LFO is actually issued.  Future buyers beware - don't allow this illegal clause to be in your contract!

Hi - hope I'm allowed to post here!

I have been following the postings on La Reserva as the situation is very similar to ours on our development - no current building licence, no LFO etc.  Also facing the dilemma of whether to complete or not (pressure from those who have because of not contributing to the community charges etc. and from the developer).

I have always been under the impression, and have read on other forums, that I am not legally obliged to complete by law when there is no LFO.  If this is correct, how can it be that the developer can threaten to impose fines for every day that I haven't completed?

Hope one of you can enlighten me as it seems my situation is similar to that at La Reserva.  Any help/info appreciated as I'm really worried.
