We are in the process of taking Aifos to Court but have been waiting for a court date since December with no date in sight.

Our lawers have informed us that the claim was accepted, however it is in the queue and waiting for assignation to a specific court.

Is anyone else in this situation?

Also, does anyone know how we can contact the courts direct(tel nos/addresses/contacts etc) as i am concerned that by the time we get a date Aifos will be in administration!

 

Any help greatly appreciated

As I'm not convinced the appartments will ever be finished, I am trying to get my money back via Jose Manuel Montiel ( different solicitor to the one that has been contacting you) at Marbella solicitors. 

We are signing the power of attorney with a UK notary this week.

Rob/H you might find this interesting - In the contract Aifos apparently commit to having the build complete 24 months after the architect signs off the plans. It is on this basis that our new solicitor believes we can go after aifos for breach of contract. As the build itself commenced well over 2 years ago and is unlikely to be built until the end of 2008.  There is obviously a risk we will not be successful...but hey we took a risk once before on a safe bet off plan purchase so what the heck!  :0)
