We  didn't  like  the location of OTCC  so we transferred from ACC to MCC off plan, beginning  2008.   Our solicitor  confirmed  the plot has full  planning  permission.  Completion  due Oct 2009 and guarantees  within  a month  of  signing the  contract.     As you  can  probably  guess, we  haven't  received  our  guarantees (again) and  the  building  hasn't  started.  We are  pursuing  Huma  through the  courts.  I  wouldn't  buy  anything  off plan from Huma -  be careful.

This the  letter I have  just  received  from my  Agent.     This  letter  was a reply after  hearing  that  ACC  would  not  start  for  another  12 months.

My agent  anticipates ACC  should  get the  full  permission within  the  next 2 months.   Who  knows!!!

The secretary of Cuevas could not be confirmed what was stated in his mail, or in any case the information is incorrect, since they have made the appropriate inquiries, and for the following reasons:

-- It is true that the Comprehensive Plan has been adopted in part, but it is also true that the actual delegate said by active and passive that deficiencies in the plan can be overcome in short time, and that the council could present solution to the same for the upcoming meetings of the Commission. In the case of ACC, this draft has no problem to be approved and classified the area as housing, because it meets the law, when it comes to assignments for parks, sports, education and so on. ACC is put on hold because the Board itself links (getting into the same bag) with other areas more complicated to solve, such as the 2500 houses have been built in Palomares the controversial delimitation of urban land. In the case of dovecotes, also can be settled "said Delegate, but subject to compliance with the Act with regard to allocations, free spaces.
-- Solving these problems will own the municipality of Cuevas and it is working. El secretario de Cuevas no puede haber confirmado lo expuesto en su correo, o en todo caso, la información es errónea, ya que se han hecho las averiguaciones oportunas, y por los siguientes motivos:

 

-         Es cierto que el Plan General ha sido aprobado parcialmente, pero también es cierto que el propio Delegado ha dicho por activa y por pasiva que las deficiencias del Plan se pueden subsanar, en breves fechas, y que el ayuntamiento podría presentar solución a las mismas para las próximas reuniones de la Comisión. En el caso de ACC, este proyecto no tiene problema para ser aprobado y clasificada la zona como urbanizable, porque cumple la ley, en lo que se refiere a cesiones para zonas verdes, deportivas, educativas etc. ACC queda en espera, porque la propia Junta lo vincula (mete en el mismo saco) con otras zonas más complicadas de resolver, como son las 2500 viviendas que se han construido en Palomares con la controvertida delimitación de suelo urbano. En el caso de palomares, también se podrá solucionar ha dicho el Delegado, pero siempre que se cumpla la Ley en lo referente a dotaciones, espacios libre etc.

-         La solución de estos problemas la dará el propio ayuntamiento de Cuevas y en eso está trabajando. El POTALA o POTLA (plan de la Junta) no solucionara esta situación, en tanto en cuanto que sólo prevé como zonas urbanizables básicamente (zonas de oportunidad), el llano central que afecta a seis pueblos (Garrucha, Mojácar, Turre, Vera, Bédar y Antas), otra en Carboneras y otra en Pulpí, sin perjuicio de otras áreas industriales. El ayuntamiento de Cuevas ha pedido en sus alegaciones que su municipio tenga también algún área de oportunidad pero esto está por ver y no es previsible su aceptación.

 

En definitiva, el ayuntamiento de Cuevas ha sido muy ambicioso en sus pretensiones; pero la situación puede resolverse, hay voluntad para resolverlo y se está trabajando en ello, por tanto no existe esa alarma y debemos ser prudentes al respecto.

I am  glad  you  happy with  your  decision  to move to Oasis and  wish you  well.        For us  there  is  not  option,   Huma  are not  offering  anything  equivalent to  the Donana  and  we would  like  something  we can  use  in  2008.   We haven't  any  bank  guarantees, despite  contantly  asking for  one  and  we have  a letter  guaranteeing  our  money  with  them,  which  isn't  worth the  paper its  written on.  Huma  do  not  know  what  is  going on,  how many  false  promises  have  we all  had.   I  have  lost  all faith  in them  and  simply  want  my money  back  so  we can buy  something  we can  use soon.  Our  solicitor tells me  that  Huma  legall   department  are dreadful,    evasive,  never  returning  calls/replying e-mails.  This  is  not  a company  I  want  to  deal  with  again.   We  will  take  them  to  court  if necessary.   Sorry  to  sound  so  negative but due  to  family  reasons ACC was going  to  be  a family  holiday  home,  for  us  and also  a ill  member  of my  family,   now  its  too late!!    No  amount  of  compensation  will  ever cover that.  I wish  you  well and  a happy  mothers  day to all mums  out there.

They  are still  waiting  for the  final  stamp, before  they  can  go ahead and  return to site, after the  meeting  12th April.  My  solicitor  said  that  this  would  not  be  until  after the  elections, although  the  elections  have  really  nothing  to  do  with  it.    I am told  that  Huma  are a big  Spanish  Company  and  they told  me  they   have  several  developments  in the  same  position but others   that  are being  completed.    We also  have  not  received  our  bank  guarantees  for the  deposit paid  in  2005 and  that  is  why  we were very concerned.   However,  on my  visit they  have  assured  my  that  our deposit  is  safe and  the  banks  will  issue the  guarantee  once  the  final  paperwork  is  in place.  Looking  at their  office  and  seeing  the  other  Developments  they  have,  made  me  feel  happier.    At least on completion  we will  be certain  that  all the  correct  documentation  is  in place.   Lets  all  stay  positive for  now!!
