just to advise after many  years and an appeal, the insurance company who provided the bank guarantee at dona julia, have returned the funds to the court, so i will be reimbursed shorly

whilst i still dont understand spanish law which relates to this issue, i believe that because i was one of the first who committed to the development [dec 2005], sufficient time had passed within my contract [ the developer had 24 months to complete, and a further 12 months leeway] prior to the licence for occupation granted on 1st may 2009[ if i remember correctly]

thus i would recommend to any of you in a similar position who arent pursing a claim to take legal advice, and hopefully the courts will rule in your favour.

i have used martinez echevarria in puerta banus as lawyers, who have a specialised litigation department

hi there

just to advise the court have decided all my monies should be returned including interest. This based on the time vthat lapsed between signing the contract and the licence for habitation being obtained. i was one of the first to buy having signed i think in dec 2005.

unfortunately its not all good news as the insurance company who i served the court proceedings on[ as proprieters of the bank guarantee] have now appealed!

the action i served upon them was in sept 2008, and it looks as though the appeal proceedure will take several months/years yet!

terry or stan ar best to ask, they are living there, i am just an investor

i have 3 bed i completed a month ago, so its early for me to comment

quality pretty good, i have great views towards marbella

getting snagging and other communal issues sorted seems a little hard work, promaga seem slow but terry/stan seem to be in charge of the community which seems to be working

i suspect there is no claim against promaga, any action would be against the issuer of the habitation lcence
i dont know who is this is, maybe the local authority
