Hi,

I applied for builders mortgage 6 weeks ago (have been living in Sucina for 5 months) and have only today heard that I will get word about my application first week in June. My lawyer has had my Habitation Certificate for some weeks now. No problem with building as far as I can see (and I visit my flat every week). Snagging done and only some small problems. Road outside access to building will be ready in 2 weeks. Swimming pool half tiled. Have had someone in to measure up for Bug Blinds.

I will be moving in to stay as a resident there hopefully mid June.

I have been living as a Resident of Sucina for 5 months now waiting on my completion. Habitation Licenses are all to hand but the hold up for completion date of last week in May has been CAM bank in Alicante who are handling mortgage applications. While at my flat today getting quotes for bug blinds I was told that 4 people are completing in next week or two as they don't need subrogation mortgage. The builder is cracking on with the WHOLE building and is in no financial difficulties as I have got to know him and his family since I moved here.

Cam bank have told me that I will get word of my mortgage 1st week in June and then hopefully I will move in permanently mid June as I only have to move my furniture from my villa here to my flat.

If anyone needs help with quotes for anything, deep cleaning, bug blinds you can reach me via this site. I have had someone do an initial snagging but nothing major found. After completion you will be allowed only 1 snagging to be done and submitted to builder.

Most of retail units have been let on ground floor. Upper is moving from across the road to our building, and we shall have a Spanish Restaurant/bar near roundabout, a coffee/cake shop, a hairdresser, furniture shop, plumbing merchant's office, and possibly another bar or restaurant.

In last month or two the following have opened up in village: Fish & Chip Shop, British Butcher, Indian Restaurant, and Pizzeria.  Cost Cutters has closed down (probably because Iceland is just down the road at San Javier.

Following are plans due to happen by September:

Pedestrianisation of centre of village near Church with seating outside for bars/restaurants there.

KwikSave changing into a restaurant but looking for other premises for their shop;  Frank from Bodega is building an outside bar area on waste ground opposite their bar/restaurant; bypass should be completed; road to Hacienda Requelme to be finished .

My friend bought off plan February 2006 in Phase 1, me in Phase 2. Both contracts stated August 2008 as completion. She gave power of attorney to solicitor but was given no notice of reecent meeting with notary  to complete. She has now been offerred a much lower subrogation mortgage than originally discussed with builder's bank. Not a single lawyer turned up at notary's office (other buyers in same position with mortgage).
We have just found out that the glossy published document which gave furniture and details of spa, restaurants etc, plus rental guarantee, developer going to operate as a 5* resort complex, are not going to happen. We didn't realise that what was in the SALES document should have been in our contracts. We knew when we bought that a higher price was being charged to have the furniture and rental guarantee but felt it would take a lot of pressure off.
We now find out that there was never a bank guarantee issued to our solicitor (because of some problems with the bank). My friend is now being faced with 6% interest from April for not completing at notary. She has still to sort out a mortgage because the bank is not replying to her emails. 
Can she just withdraw because of the lack of bank guarantee?
I have been offered return of my deposit, but no mention of interest.
Our lawyer was paid upfront, so are we entitled to return of some money paid for legal completions costs?
