We finally recovered our deposit through an action taken against the banks by our Abogado (Martin in Abolex - many, many thanks). We would strongly advise anyone that has paid over a deposit to insist their lawyer takes the necessary steps to try to recover it through the courts by taking action against the banks that did not issue bank guarantees. If this is a route that your current lawyer is not prepared to go down then we would advise that you seek the services of a Lawyer that has already successfully recovered their clients deposits.
This development will never go ahead. The following figures were given out at a meeting between San Jose/HdelTollo management (including Almudena) and clients in an hotel in Dublin prior to solvency vote. The original plan was for 10,000 units but only 1,500 deposits approximately were ever received. Less than 300 of these 1,500 customers received bank guarantees meaning that spanish law was broken at least 1,200 times. . The only way the build can go ahead is if those clients that have already paid deposits decide to continue with their purchases as this is the only income the company will have for this particular site. The building of an hotel, equestrian centre and even one golf course will simply not be viable.
Please, Please take the advice of Great Auntie Linda - seek the assistance of a decent abogado and try to recover your deposits before the situation deteriorates even further.
