I have what Palmera termed "the Spanish Builders Contract", which I received around 10th March 2003. Does this refer to it being a "State Subsidised Dwelling" or something more sinister?. Please elaborate.

Regarding the extras, you're under no obligation to accept or pay for them. If you accept them, it has to be at the builder's cost, unless, out of the goodness of your heart, you want to contribute towards the cost. If not, tell them to take a hike.

Why not mention the garage-it's a valid point and is the "link" in Mirador Linked Villas.

I spent 4 hours at the site on 13th October and couldn't find my garage. If any of you know where it's hiding, please let me know.

As for the extras (if there are any), they are supplied with the compliments of Grupo Mirador. You are under no obligation to accept any of them and in fact can insist they are removed and all work made good, if you so wish. If you're not bothered either way, Grupo Mirador will have to pay for them themselves. As far as I'm aware, no investor was given the choice to accept or decline these "costly" items. If they are being installed, it's at their cost risk and for their account. The law states "no individual or entity can tempt the pocket of another individual or entity without their express written agreement and consent".

I visited on Friday 13th October (ominous date, but life's like that) to view my property. Not a worker in sight, nor a garage (is it just me that wonders where the ****  the garage with up-and-over door is?). These properties are still being described as "linked villas". The link is the garage.

Another more important point; the property I was shown on the 13th by the guys from Palmera was not as indicated in the original literature I received with my reservation contract in November 2002. My original property was facing onto one of the comunal gardens. Now it's in a side road facing another villa and the rather high wall of the olive oil factory. I subsequently met with the sales manager of Palmera and questioned him on this. When I showed him the sales literature I had been sent, he said that I shouldn't have received it as it was only available to the salespeople, online through a secure login with a PIN number. I asked what alternative literature was available for the investors. You can guess the reply-none!. I've since found out that the literature I had was the same as the other investors.

More info. No First Occupancy Licence available yet so no mortgage or utilities. The Nota Simple is apparently with the Land Registry but I've yet to see a copy.

There is some talk of a "comfort package" being installed by Mirador at a suggested cost of €12k. This is complete bull****. Any optional (this means having a choice) extras installed without the express written agreement and consent of the individual investor cannot be forced on the investor at a cost; Mirador will have to remove all and any of them or swallow very hard.

I met with my Spanish lawyer both before and after my visit to Fuente. He tells me I have an indisputable case against Mirador. That's the good news. However, it will cost €6k to get the case to court and take 12-18 months for a hearing. A group action would reduce the cost per head but unfortunately the same doesn't apply to the timescale.

Just to make your days even more enjoyable; my lawyer is in the process of suing the builder that issued our building contracts, on a totally unrelated case. One of his clients bought a large parcel of land for development (my lawyer didn't act on the purchase) from the very same individual. It transpires he had no rights to sell the land, it's bogged down with liens and charges to the world and it's brother and the chances of development are as remote as Tuvalu; no, that's a bit strong, Tuvalu isn't that remote.

I'd like to repeat my lawyers opinion of this builder, but under 18's may have access to this site and I can't afford the grief that would undoubtedly follow.
