I was advised by my lawyer not to try  and reclaim plus valia on my situation 

while it’s under appeal there’s little chance  and even then it will be an expensive process 

only hope is that once it’s confirmed that the plus valia. Payments are illegal then certain lawyers will operate the same system as they have with getting people’s money back from off plan deposits on a no win no fee basis but take a percentage

That is correct

and the councils still demand payment despite ruling

it just seems a bit worse because your not even realising an asset

Hi and thanks

there was no IT due

there were all sorts of other Charges of course but the amount paid to Casares council for Plus Valia Was as stated

just in case some people are not aware.

following the death of my wife I had to pay €3061.00  plus valia as her 50% was deemed as being sold to me 

so,although the property stands at a 40%loss since purchase and it has not been sold I still had to,pay.

i have just paid plus valia tax on 50% of the land revaluation following the death of my partner 

if I now decide to sell will I pay tax on the remaining 50% or do I have to,pay the 100 % which means I shall be paying half the tax again
