Hi,
I am new to this site and am relieved to see that there are other buyers in the same situation as me. We paid our deposit on El Pinet at La Marina back in June 2004. We were told the property would be complete by December 2004. We paid a bit more money in December 2005 as instructed by our spanish lawyer as a gesture of goodwill to San Jose. Shame their good will has not been reciprocated.
I have an independent spanish lawyer who has an office in London and in Alicante who is regulated by the Law Society and he has been very good. The latest information I am aware of is that the building licence for El Pinet has been put on hold until November as the local conservationists have complained again to Elche council that the development is too near the natural sand dunes and the sea. I understand that they can agree with them or let the building go ahead anyway!
My lawyer is currently looking into a cancellation for us. However, he says that San Jose are not breaching their contract - having said that I cant believe that they can hold out indefinitely if they are not to be awarded the building licence.
Has anyone any further news. I hope to get some feedback from my lawyer this week.
