What I don't understand about this whole issue is that it is rife in Spain so why does the Government not intervene. There is no other epidemic that would be ignored like this. When the PPI scandal hit in this country it was Immediately investigated and rulings put in place that the Banks had to adhere to, they weren't allowed to ignore them and as a result people are getting their money refunded without going to court to wait for a decision.......what decisions are they waiting for!!  Some people got bank guarantees some didn't all from the same banks so where did the lack of understanding come in as to what the money was for?! The building account would have a been a huge account with the Bank they would have known alright that the money needed to be protected but I guess they were doing the builder a favour and releasing the funds only now to find it has all backfired on them. So......one investigation on each Bank involved will tell them all they need to know!!  No courts neccessary.

Congratulations on winning your case..........it won't be long before you actually have the money in the bank.  We were also with Fuster but ours was settled out of court, however, the money still has to come from the bank to the solicitor so I can't see time scales being much different.  We had no idea we had been awarded our money back until I chased it up on the 16th Nov and was told "congratulations".........after several enquiring emails and phone calls as to where the money was,  we eventually rec'd it on Christmas Eve with the promise of a full breakdown of costs to follow which we still haven't rec'd. So to answer your question in our case nearly 6 weeks but we don't know how long before I chased it up that the agreement was made.

Because of favourable euro rates particularly on the the first refund which was almost 1 for 1 (2010),  after all solicitors fees on both claims including the 20% agreement and the initial £2000 non refundable deposit we have come out of this approx £3000 up. I realise we would probably have earned more interest if it had been invested here but to say I'm happily relieved is an understatement.  Don't forget with taking the banks on you get the interest on your money for the years they have been holding it, that takes care of any fees owed.

We had a joint action against Cajamurcia through Fuster,  we had no bank guarantee for this payment.  Cajamurcia did not want to go to court as they had lost previously so they settled before hand. The banks know they are at fault as they knew what the money was for and failed to protect it by putting it into a special account.  We were told no bank guarantee is neccesary only proof of payment to the account which your solicitor should have.  We had a no win no fee deal and after a 20% cut taken by our sols we still came out with our original cash.............. good luck everyone

Today at long last we received our second stage payment back, a great Christmas present and I still can't believe after nearly ten years since the nightmare began we are now all square. Good luck anyone else still waiting out there, there is a light at the end of the tunnel.
