Thanks for this thats interesitng and corresponds with information we had end of last year from Polaris saying Phase 9 Los Tilos wasn't ready for a number of months.  We have tried cancelling our ciontract using the late completion clause and Polaris is now saying the apartments are all finished!!!  Funny that.  Has anyone any other information??

We have an apartment on phase 9 Los tilos and last time we spoke to Polaris were advised it wouldn't be ready until May/June 2007.  Our contract allowed us if the property wasn't ready by end of 2006 to pull out and get our money back.  We never heard anything by that date so our lawyer went through the motions and apparently Polaris are saying the properties are ready!  However i have been told Polaris won't let our lawyer get into photograph them.

I have found out from various sources there are at least 20 other people who have cancelled in line with their contracts but Polaris are disputing them saying they are ready.  Looks like we are going to have to go to court!!!

 

Anyone got any similar experiences i am trying to get together a united voice and find people in the same situation, if we can form a united group it provides more weight than individuals against Goliath.  If anyone is living on La Torre and can get photos/video of Los Tilos then that would help as we are in the UK - that would really help.

I have a similar issue with a large developer in the Murcia region (Polaris) who in the contract stipulated an exact date the property would be ready by otherwise we had a two week window to notify them that we wanted to pull out.  This we did through our lawyer.  Now our lawyer is telling us that Polaris are now saying the property is ready however neither ourselves or the lawyer ever were notified it was by the date.  We have found out there are another 20 people who are also in a simlar situation trying to cancel contracts and the developer saying the property is ready.  However our lawyer says he has tried to photgraph the properties but has been refused access.

Anyone else having similar issues???

Anyone heard anything about Phase 9 completions or anyone having problems cancelling their contracts??  We are and understand there are many others in dispute over their cancellations.  It might be good to hear from others to join forces/stories.
