I have just returned from Spain, while I was there I thought I would go and see my lawyer as I had not told them or used them for my Trampolin Hills dealings so far.
I had also made my mind up that getting my money back from TH was nothing more than a dream and so although I have joined various groups had decided not to throw any more good money after bad, but last Tuesday I went to see my lawyer on this subject.
I will try and remember all he said, though I cant promise that it will be in the correct order he said it, nor should any of you start any arguments as you have heard different from your solicitor I am simply telling you the outcome of my visit.
So I started by asking if he had heard of TH, his answer was,
Not only had he heard of TH but some of you will be his clients, he has already won cases against them, but it seems that only 2 outcomes have been reached , that is that clients did not get their money back but had embargo's placed on TH properties, the other was that those winning clients also had their contracts cancelled.
The other dealing he has had are that an estate agent got in touch with him and said that they were very concerned about the selling of properties for TH, so a meeting was set up with him and the estate agent and Antonio (you know the one they call the gypsy) my lawyer asked about planning permissions and bank guarantee,s etc , at this point Antonio threw a fit screaming at my lawyer , he did not have to prove any thing, he only mentioned that he was doing things how things were done in the building industry just like Polaris and others.
My lawyer is also representing many buyers on El solera.
So now back to my case, TH were forced into liquidation which means the owners now have no say in its dealings , a highly respected man has been appointed to deal with their assets and debts and his report should be completed by approx Easter next year.
If he finds that TH have money , lets say he can find 1 million Euro's for example, then that money will be distributed to the people or companies owed , however its not that simple because it is paid in priority order, for example if TH owe money to the government they will be top of the list, my lawyer mentioned several high, medium , examples and guess what , us lot are the lowest , our chances are by far the smallest.
My lawyer is dealing with other clients who have similar problems to ours with other developments, but told me that TH is the worst company in Spain, he said though possible he thought it highly unlikely that the TH development would be taken over as some of the other struggling developments have been, also those of you like me who have not yet had your contract cancelled by now are too late, which is a bad thing, should any of you like me, not want to continue with your TH property, your contract can be enforced and passed on to the new company should there be one.
I told my lawyer that I did not want to throw any more money at this, but he told me a few things about the good work of the man with the job of auditing TH and that it must be worth persueing as there may be a chance of at least seeing some of my money returned, so I have instructed him to proceed and put a claim in to the creditors which most of you will know has to be in by December 2nd or 3rd
I suppose he told me a lot more than this but this will do for now, as for my opinion on TH going a head there must be many buyers who have had their contract cancelled and may more who now cant afford it and those who simply don' t want to continue and there certainly are no new buyer's so who will buy there, there's no chance of it being the same size development, would you take it on ? build all those houses , honour the deposits already paid , no neither would I, my 66,000 Euro's would sure come in useful now, but for sure I wont be a resident of campos Del Rio.
