Dear All

The good news is that we have now received our deposit back (from our solicitor Victor in Vera!) even though our bank guarantee had expired  the year previous and this time the  exchange rate worked in our favour instead of against.  Having said that we would have still prefered things to have turned out as planned - however life has its own plan, we now have a beautiful granddaughter, our first and possibly the only one, she is quite a handful but  at 62 and 63yrs old we had kinda given up all hope on that front.  The not so good news is that we now have to start again but this time we will be looking for a holiday home instead of relocating we feel like we have gone full circle.

One things for certain we will not be buying off plan again.

We too have not heard from Victor since before Christmas, nor Medsea (although it now seems the office has taken on a ghostly form) but strangely enough yesterday we received an email from Patricia in the sales office, saying in her own way, that they are waiting for us to complete - and still no word from Victor!

We recieved an email from our solicitor 4  Dec, Victor in Vera Via Medsea our agents. We are on phase 4 plot 32 our house is finished but has no habitation liciense.  He is advising us to pay the outstanding money even though the paperwork is not fully completed (so the property is in our name)  but we are reluctant to do this because if we do not have the habitation cert . we would not be able to sell it (not that we want to) but it must mean that it is not completly ours?!  We were also hoping for white goods as some form of compensation but we are told there are no white goods because Peinsa have no money.  We have lost confidence and are reluctant to part with the remaining money plus with the pound against the euro it costing us thousand of pounds more, that we do not have.

We have only been waiting since March 2005.

Hi Mike,

A few months ago we wanted to cancel so we went to see our solicitor who said that it would not be a problem BUT as our bank guarantee had just run out he recommeded that we wait until it was renewed and then he could just apply to the bank for a refund.

However, Pensa has now put in a clause (an amendment to the bank gurantee) basically it says that if we want to renew our bank guarantee we must sign up to this new amendment which says that we will still purchase the property when it is finished.

We did not sign up to this but have since told our solicitor that we will still purchase it as it was almost fininshed.  This was a couple of months ago and its still not fininshed and as we all know the country's financial crisis has deteriorated considerably and we could now do with our deposit back.

Was your bank guarantee still in place when your solicitor recovered your deposit?

Our concern is that as we have verbally agreed to buy it with our slicitor and it seems that if we still want our deposit back we will have to take him to court. 

Do you think the solicitor you used could do anything for us without taking him to court ?  (Would you pass on his phone number?)
