I have a clear statement from CG on the issues concerning the COH and I have been in regular and informative contact with them over the last few months. This is why I have stopped posting and I would urge you all to contact CG with your issues if indeed you are genuine buyers or propsective buyers and from my experience you will get an informative response.

When you buy a house in the UK, who do you go to with queries? Your solicitor, the vendor and the estate agent. I suggest you adopt this approach here coupled with site visits if possible.

To Toddie and those of you with genuine intent.

I agree that some folks have come on to this forum to be agressively negative which helps none of us. So this will be my last post also. But lets not lose sight of the fact that I have for example just booked my 2009 holiday in Spain in someone elses villa at my expense. I should be enjoying my home at Finca Parcs this summer and should have been for the last year or so. So whilst I disagree with the agressive stance of those folks mentioned, I personally have tried to remain balanced. This does not change the fact that I am a number of thousands of pounds down with no end in sight.

And whilst I try to stay optimistic, and was really looking forwad to someone posting to say they were in, their transaction had concluded satisfactorily and they were happy with the end result, today it is the 18th of January 2009. We enter yet another new year enough said I think.........................

Hi Deb C

Good to see a new contributor. I am on Phase 4 and sadly it looks like a distant dream. There have been no bank guarantees issuesd and there is no defined plan of any substance for the build. I have been presented with options to make a legal case agains the developer based on the lack of progress and the failure as agreed and advertised to issue a guarantee. However having looked into it you need to way up the a) cost and b) potential for the due process to take a long time. For me the world wide propoerty market is shot, and if things had been different we would all be in now. So take a view on the comments here and take legal advice, but as  a long standing contributor to this site, for what its worth my opinion is that all phase 3/4/5 customers can do is wait it out until something 'official' is communicated. See if the phase 1 guys ever get in and then see if things start in earnest in the later phases. One thing I can confirm is that CAM Bank are not funding the project past phase2 so if they do not all sell and complete on 1 & 2, there will be no money in the pot for the other phases and certainly not for any swanky commercial centre.

Like I said previously  5 yesars down 30 houses 'complete' only 600 to go!

My understanding of this position is as follows:

The building license has not totally been cancelled, it is a voidable act and therefore they have to take the process back.
1) On the 27th of April 2007 Cleyton Ges and the Town Hall of Hellin, were taken to the admisnistrative Spanish Courts.
    The reason of the legal action was to declare the building licence for phase 1 ,either:
a) Void- Totally cancelled.
b) Voidable- Subject to be ammended.-
Therefore, the case was against the building license for phase 1 issued by the Town Hall of Hellín on the 15th of March 2007 = 105 Detached Villas.
 
2) The area where the site is being built is a Protected Area and therefore an specific Report from the Environment protection Department was required to the Town Hall before issuing the building license. 
 
3) Cleyton Ges will have to get this Report
        - In case they get the report - They will get a final building license.
        - In case they do not get the favourable report- They will not get final building license.

I have no idea if this is a major issue or the risk of the required report being unfavourable is high or low. But given that the action was 18 months ago and the required report is still not in place and the fact that the licences have been issued without the report is a little odd.
