n MÁLAGA. La Fiscalía de Málaga ha remitido al juzgado decano de Antequera las diligencias de investigación correspondientes al proyecto de urbanización Valle del Rosario Golf para determinar si se ha incurrido en un presunto delito contra la ordenación del territorio.

Esta investigación se inició tras la denuncia presentada en agosto del año pasado por la asociación Ecologistas en Acción contra este proyecto, que incluye una urbanización con campo de golf y un complejo comercial, por supuesto incumplimiento de las normas subsidiarias del municipio de Villanueva del Rosario e incurriendo en un supuesto delito ecológico por la destrucción de un importante hábitat para la fauna.

A raíz de la denuncia, el fiscal de Medio Ambiente pidió una serie de diligencias tanto al Ayuntamiento afectado, el de Villanueva del Rosario, como a la Delegación Provincial de la Consejería de Medio Ambiente, pero hubo una "nula colaboración administrativa", según informó ayer en un comunicado el colectivo ecologista.

Ante esta situación, el representante del Ministerio Público remitió el caso al juzgado decano de Antequera para que repartiera el expediente. Según Ecologistas en Acción, desde el pasado 30 de mayo se encuentra en manos del Juzgado de Instrucción número 1 de este municipio, que previsiblemente lo remitirá al partido judicial correspondiente.

El proyecto denunciado pertenece al Grupo Mirador y a la empresa Aifos, se encuentra actualmente en construcción y abarca una superficie superior a 1,7 millones de metros cuadrados.

Según Ecologistas en Acción, el complejo urbanístico podría elevar la población en más de 4.600 residentes.

Las actuaciones llevadas a cabo hasta la fecha han supuesto la muerte de unas 600 encinas y quejigos, la "invasión" de una vía pecuaria bajo el vial de la urbanización y el enterramiento de dos arroyos a lo largo de casi 300 metros, según los datos aportados por el colectivo ecologista.

Fuentes cercanas a una de las empresas responsables del proyecto negaron ayer que se haya cometido ninguna irregularidad y aseguraron que el plan "se ha hecho conforme a la legalidad". Informaron que el expediente consta de los preceptivos informes medioambientales y de licencia concedida por el Área de Urbanismo del Ayuntamiento afectado.

Due to the number of people requesting images please go to "Shared Photos" where you will find 4 batches of 6 images dated 5th May 2007 taken on site.

The construction works is 100% Aifos but some of the roads have also been put in on the Mirador site by Aifos.

The was no work being done on 5th May as we had experienced 3 days of heavy rain - however i managed to get close enough to take these images.

I hope it gives you some idea and helps you all see the current status of the development.

Latest Update - 13th May 2007

 

Without Prejudice..

Spoke with Palmera Properties last week whilst I was once again out in Spain.

I had NO reason to visit the Palmera Offices as I managed - after two lengthy phone calls to their Offices explaining that I was in Spain for 10 days - to obtain the latest and what I believe to be the current NON Bull S**T state of play which is as follows:-....

A meeting was held with Anita - Palmera Properties and the Directors of Mirrador Properties on 4th May to discuss the current situation along with other developments currently under construction by Mirrador which are being sold by Palmera

 

Mirrador apologise for their lack of communication and support due to lack of management support & efficiency over the past 12 months

 

Mirrador confirm that they will with immediate effect improve communications and put in writing their actions and timescales to Palmera

 

Mirrador confirm that they defiantly have the Building Licence “In Place”

 

When asked to provide a copy of said Building Licence it was not made clear that they actually had it in their possession but it is clear that the Building Licence has been issued and is at the local Ayuntamiento (Town Hall)

 

It is my belief and Palmera’s intimation – but we are not sure - that Mirrador have not yet collected the Building Licence as there is a hefty Fee to pay for this Licence and with the way that properties are NOT selling on the Costa that they like all builders have a lot of empty unsold properties on their books and want to sell them before starting another development. This however is not what Mirrador have intimated.

Mirrador did say that they will be issuing contracts very soon but unlikely to commence work until late summer 2007.

Whilst out in Spain I visited the sight which has as we know been started by Aifos and have taken some 15  “Up Close – On Site images” ….

Those of you who would like to see these images that were taken on Saturday 5th May then please advise and I will forward copies to you…

Dear Coates

Involving Solicitors at this stage i feel may be a tad premature.

What i feel we must remember is that Spanish properties especially on the Costas are on their arse with more properties for sale than there are buyers.

You only have to drive up the Coast Road and or the Motorway at night to see all the new developments empty with no lights on and those that do have lights will unquetionably have a For Sale sign in the Garden.

Valle Rosario does have a number of added advantages over the Costas that being with the new fast train link along with a proposed Airport at Antequera and the nearest Golf Club at Antequera this means at least the Rosario properties will be more desirable to a wider market..

BUT... Yes i know we have got to get them built first...

I look upon it that it we have lost nothing til we sell it and when we do like all other investors we will make a profit ...

On a positive note the longer it takes the better the profit - hopefully...

It is i will agree very frustrating with the lack of information that we have all received over the past 3 years but i feel that there is a light at the end of this long Bulls**t  Tunnel but if we get to August with no Building Licence then i feel we need to consider seeking alternative legal advice as a group...

Whatever happens the Builders have stated that they will not start the build until Summer 2007 irrespective but we need to see a Building Licence before then so at least we have the option to then re-sell or keep our properties

We are off out again 5th April for 10 days and will do a site visit and also speak with Palmera & the Builders and see what the latest is...

I have however spoken to ** EDITED NAME ** at Palmera again this week and he informs me we are still at stale mate awaiting the Building Licence which we were told on our last visit would be 6 weeks - This ironically was 6 weeks ago weeks...

So i am going to make some noises at Palmera after the Easter weekend and see what excuses can be provided when i speak to them face to face and get Palmera to phone the builders whilst i am in their offices and hear their bulls**t replies and will report back...

Finally....  If Palmera or Mirador read this Post - Then please have the kettle on...........
