Howdy , it’ has been a long time since  checking out this forum however I thought the following information may be of value. 

At the court hearing yesterday ( April 18th ) in Malaga a little daunting to say the least . Banco Popular attending lawyer was  trying to entice me to say I purchased the property for investment which is their only way of avoiding paying out under 51/68 . We now have to wait and see

Good Morning,

I am unsure if any of the original members are still checking in on this forum but I believe it is still worth my own update on a claim  against Aifos for the refund of our deposits.

I received a phone call from our lawyers in Spain who informed me they have won a judgment from the courts against Aifos's bank who under Spainish Law are responsible for all off plan deposits. We are hoping to receive more positive news over the near future

The reason for the question of, any others affected by this development still looking at these threads, is I am currently waiting for confirmation of an application to lawyers to whether I have a case to take action against the bank that Aifos used to secure our payments.

Not sure who has read the national newspaper artical around a month ago regarding a Mr K Rule who won a case against a bank for him and 46 other people in simular circumstances to ours (a development near Alicanti).

Mr K Rule lives 8 miles from me and now works part time for the lawyers that won this case.

 Hi fazarelli,

Thank you for your reply I was hoping that a few more involved with this development would have picked up on this thread however so far only a couple of responses.My thinking was the more involved the less the litigation cost's would be as like others we have spent a considarble amount already trying to retrieve our deposits from Aifos.

Saying all this yes we would like some idea of the cost's involved and I would be greatfull if you could give us an idea if possible?.
