Dear Sirs,

 In the last years, we have obtained positives results going against the bank that have received the funds paid by the purchasers. Even when no bank guarantee has been issued.We have claimed against the banks in the north of Spain and all the cases were won. In some occasions, the banks negotiate before the claim is submitted because it has been already obtained a judgment where it is stated that the funds have to be returned. 

I do not know where you live because we have already meetings with people who are in the same situation, money paid and the property were not finished and no bank guarantee issued or they are told the bank guarantee issued is expired. We explain all the possible scenario and the possibilities. If you let me know the details of your case, I will let you know. Basically, it is needed the payments done to the developer and the contract. It is very vital to know that the payments went to the developer´s bank account.

Dear All,

It is true that there is a way to recover the funds paid to the developer when the construction was not finished and the developer did not issue a bank guarantee. 

We have claimed against the banks mainly in the north of Spain and all the cases were won. In some ocassion, the bank negotiated before the claim is submit ted because it has been already obtained a judgment where it was stated the bank had to return the funds.

 

I do not know where you live because we have already meetings with people who are in the same situation, money paid and the property were not finished. We explain all the points. I am also in the process of contacting the creditors of the developer as in some cases there were issued bank guarantees with an expired date which is not valid under law.

I represent a number of purchasers in varios developments who did not receive the property nor the funds paid.

I guess that this is your case also.

Although we have obtained a positive judgment against the developer, the problem comes when the funds have to be recovered. The companies do not have assets to pay back the funds.

In the last years, we have obtained positives results going against the bank that have received the funds paid by the purchasers. Even when no bank guarantee has been issued. 

Please, let me know if this would be an interesting option for you or any other buyers you may know.  To be able to claim against the banks it is basic that the property is not finished and the funds were paid to the developers bank account.

Although we have obtained a positive judgment against the developer, the problem comes when the funds have to be recovered. The companies do not have assets to pay back the funds.
