In my opinion if I was to ever buy in Spain again, and I never, ever will, you can trust no one. The sad thing is that even with an honest lawyer, it does not stop all the other dishonesty rife in Spain's property sector. A good example I have heard of just recently involving a close friend is where even the administrator of a community of owners, who is a Spanish lawyer, was prepared to accept clearly faked bills from a developer who had unsold developer owned properties which were in the community. Names and locations will remain anonymous at this moment in time until I can write something that will not affect the confidentiality I have been placed under.... So even if you buy from honest people and think you are safe for a while.....think again...

I think debt negotiation and debt restructure are very small but really growing areas, but I also think there is a massive area where Dacion en Pago alone just does not cut it. For example the ones who are in negative equity and want to walk away but protect their other assets. I know that is very difficult to do in a NE situation and that is why such a service is really badly needed in Spain right now. I am thinking any lawyer who can offer all these services will make a fortune in the current market.

Hi Maria,

I know you have posted about Dacion en Pago before (I've read those excellent posts a few times) - Dacion en Pago I hope is a last solution for many people and it relies on the property not being in negative equity (correct me if I am wrong).

So many people are looking for more than just Dacion en Pago. I think many want services for debt restructure and debt negiotiation  with the bank.

Like I say Maria there is nothing on the CL website about offering these services..  But if you do offer debt refinancing solutions then send me a PM I've a number of clients I can put you in contact with.

You did not read the post properly... and the rest of your text was edited by EoS team so no idea what you were discussing.

The services I am talking about (which are not on the CL website) are debt restructuring, debt negotiation and to some extent Dacion en Pago (being the last resort). In other words a lawyer with whom clients can go to and say  "get me out of Spain" and they will enter into talks with the bank to negotiate the client debt and write off any claims against UK or other foreign assets if that client cannot service a mortgage or other debt secured on the asset. There are very few lawyers who seem to offer these specialised services - hence why I think this is a potential growth area. I'm not talking just about Dacion en Pago I'm talking about much more than that...

Maria I could not see these services being offered on Costaluz Lawyers website, I even used the search facility but "Debt Restructure" and "debt negotiation", and additionally "Dacion en Pago" etc return the phrase "No results!"

 I think right now more and more people desperately need lawyers who can approach a bank and offer debt restructuring solutions and negotiations. I know of only a few who are very well renowned (and very expensive). If you do offer such services then send me a PM as I've a few people I can put you in contact with...

Maria the problem is that getting a property found by a trustworthy lawyer / estate agent we could 100% trust in like yourself (and my lawyer was Spanish and I still trust her to this day 100%) is no guarantee of all the other problems that infest the Spanish property market. Why I agree with the comment goodstitch44 made is that there are many other problems that go right to the government layer (corrupt officials, riduculous Land Grab laws etc etc) and without this being tackled by the government many foreign investors (IMHO) will look to safer havens with legal systems that have been proven to protect the innocent (and Spain has just about destroyed all trust and faith in that respect). I cannot remember who said this but it has been a corner stone of all my businesses: "money will *always* go to where it is treated best".

I think that if any Spanish lawyer wanted to make an absolute fortune then don't try to offer to sell things into a collapsing and distrusted corrupt market - try to offer a service to people who have had enough of Spain and want to get the hell out and hand the keys back to the bank. That is where there is a real service demand offering IMHO.
