A further meeting was held on the 9th January with much greater community representation.

This one was called by new administrators – Asemar.
 
At the meeting Juan Mata Castro stood down and a new President was elected with three Vice Presidents.
 
The new President is:                                                              
D.Diego Rivero Maldonado
 
And the Vice Presidents are:
D.Fernando Sanchez Soler
D.Juan Carlos Rodriguez
D.Juan Mata Castro
 
The new budget for 2009 has been set at 80,000 Euro’s.
Asemar are registering everyones details and collecting communty fee's by direct debit.
They have also set up a website for the community for which they will provide login details so that you can keep track of what is happening.

A six page letter, in Spanish, has been published by a group that has apparently elected a community president.

A meeting was held on 10th of October at 17.30 and Juan Mata Castro was elected Presidente Entrante and Jesus Ramirez Martinez was elected Secretario/Administrador. There is a list of 24 Spanish names and their addresses in Terrazas de Torreblanca.  It can only be construed that they all voted for him. 

The final page lists what they expect the community costs from Nov 2008 to Nov 2009 will be and this comes to €119,428.92.  From the breakdown of the costs there is 47K for the pool and gardens, 11k for maintenance, 3.5K for something called "Prima seguro Multirriesgo", 18k electricity, 18k water, 16k admin and 6k reserve.

We really do need get a community off the ground but I do not know of any English owners who were even notified that the meeting was to take place and although there are 24 Spanish owners listed it is not certain that they were at the meeting either.

Does anyone know of anybody who actually attended this meeting or was notified that the meeting took place?

And what are the legalties of having someone elected as President if not everyone is even given a chance to vote?

There is at least one other risk.
I have heard of one apartment where the purchaser cannot complete because the courts have placed an embargo on it as they look for Aifos assets to pay for claims.
I have no idea what this will finally mean to the purchaser of the apartment but this is the reason that I completed on my apartment.

My understanding of where we are:

Fuengirola council will not issue the First Occupancy License because Aifos have overbuilt on the development.

Apparently the problem is that the ground floor apartments were supposed to have cellars.
Aifos turned these into one bedroom apartments and therefore instead of having 161 apartments the development has 203.
The amendment of this overbuilt space on the project has been presented to the Townhall and this new project has been initially and provisionally approved.
The final ok has to come from the main department, which is the "Junta de Andalucía" in Malaga. This office will check everything and will most probably decide that Aifos will have to pay a fine for this change and get the license granted.
This could take anything from 3 months to a year.
(My solicitor thinks 6 months)
Aifos is currently contacting purchasers to get them to complete (possibly invoking the three month admin silence rule).
Banco Pastor is also granting mortgages so the purchasers can complete.

I have recently been contacted by Aifos who are telling people to come and complete and collect the keys.

I haven't actaully spoken to to Aifos myself yet because every time I phone up I get stuck in a queue, and I haven't got time to hang on in a queue.

Since the habitation license hasn't been issued my solicitor, and the solicitors of others I know, have advised not to complete.
