There is no change to your contract as these contracts where originally done in the name of Sol Mijas Developers S.L  (Not Majestic) The new owner has acquired the company Sol Mijas, therefore it is not optional or good intentions as to whether they are going  to honour your contracts or technical specifications, or not; its a legal obligation. The ownership change of Sol Mijas SL is irrelevant to your legal contract.

Majestics role in La Condesa is one of assistance. We are dealing with all queries until such time as the new developer has set up a suitable communication system. After this we will remain in contact and giving updates to all clients who bought directly through Majestic as agents aswell as taking care of their investment portfolio. I presume those who bought through other agencies will receive the same service from them.

An e-mail, approved by Directors of Majestic was sent before Christmas to all owners explaining the current situation. Our solicitors have also communicated with our clients solicitors. By all means, if you still do not understand what is going on, please contact me and I will be happy to explain.

With regards to your statement of me not assisting you and "hiding behind solicitors" ; I am not a lawyer, therefore if you have a legal question it is only logical that I refer you to our lawyers. 

Most owners are enthusiastic about the recent activity on site and what this means for their investments.

Dear All,

Just to keep you up to date on progress at La Condesa. As you all know, the new developer, José Luis Cortes have already begun progress with a healthy work force onsite. Hopefully by the end of the week we will be able to supply you with a direct contact telephone number in order for you to follow progress. In the meantime, please contact me if you have any queries.

Regarding one of the posts on the site, I would also like to take the opportunity to clarify that Gill Malouf is NOT an owner at Majestic Gardens. If Gill, you are confused as to the development that you have purchased, please give us a call and we will be happy to clarify this with you. I think these forums are a useful tool for research when the intentions are not to mislead others.

Dear Owners of La Condesa,

 

As part of our ongoing commitment to communicate the progress of works at La Condesa de Mijas Golf, we would like to take this opportunity not only to wish you a Merry Christmas and a Happy New Year, but to relay some important news regarding the project.

 

As you are aware the project has seen some unfortunate delays due to several circumstances that were beyond anyone’s control, these circumstances have not only caused delays at our Mijas site, but on our other sites as well.

 

In a proactive move to ensure that no more delays are incurred, Majestic has taken some necessary steps to ensure the imminent completion of La Condesa de Mijas Golf.  As you are aware from our last update we have been in talks with the financing bank, Banco Pastor.  An agreement has been reached that we believe has the interest of all clients concerned.  Banco Pastor has helped to find a third party contractor who will now take sole responsibility for the completion of the outstanding building works.  Majestic will of coarse be on hand to aid all property owners throughout this transition.

 

Majestic consider this to be the most stable option for the present owners as completion of the development will be guaranteed by the bank.  Ultimately, Majestic would like to see La Condesa progress into the quality development that it will be on its completion and ensure all owners are happy with the end product.

 

Although Majestic will have no further links to the completion of La Condesa, we will still take responsibility for actively re-marketing investor units through a variety of retail activities which we have in place.  We are also continuing to pursue other avenues to ensure all investor units are sold prior to completion.

 

Finally, as the year is drawing to an end, we will be closing our offices as of Friday the 15th December and will be reopening on Monday the 8th January.  Once again we would like to thank you all for your support through out 2006, and wish you all a Merry Christmas and a prosperous New Year for 2007.

Dear all,

I hope all of you are doing well. I apologise for not having sent yet an update on the situation at La Condesa, but I am waiting for the full work force to be on site to do so. As soon as they are all there, I will start informing you on a day to day basis of what is the process and you will be kept updated on all what is being done.

I would like to clear a point about the above mentioned post (with no intention of disrespect to anyone) so that this does not lead to any confusion or misunderstanding.

Banco Pastor have always been the bank who have financed La Condesa. Yes, there has been a new agreement, but this is strickly to do with a revision of the finance, in order to guarantee the completion of the development.

I would like to reasure you all, that we at Majestic are working to deliver your property to you, at the expected standards, within an agreable time scale and that we will continue to assist you in the most effective and accurate way possible.
