I would have thought any penalties would have been on KM as they have missed their completion date in the contract by more than 3 months.

Some thoughts

1) Dont disagree that gym equipment should be supervised, but how will the restrictions be policed?  If Health and Safety is an issue then we should all be given a key, which is the responsibility of the owner. This would stop children and non residents using the facilities

2) Is the proposal that children shouldn't be allowed to use the pool as well?  I dont agree with this. I have children and would expect to use the apartment out of summer months and expect my family would want to use the indoor pool from time to time.

3) However, if people are restricted from using the facilities then this should be reflected in the community charge and a separate membership scheme setup that people pay for.  If my family is not allowed to use the facilities then I dont want to pay for them.

Who said you  couldn't  cancel without losing the deposit?

I'm looking into cancelling as well.  I've read through my contract and the main terms are

Key Mare had to complete by Sep 2007

If they didn't them the purchaser has the right to the return of payments on account plus interest

I thought these were pretty much standard terms that had to be included.  I'll go and check again

Has any one looked into the question of compensation, becasuse the completion date has been delayed?  I seem to remember that KM had an obligation to complete within three months
