Hi All,

Can anyone confirm if they have received money back from the Bank in relation to purchasing at Nueva Ribera Beach Club, Phase 2?

My solicitor emailed me in January 2018, after years of little/no progress or update, stating that the bank had made an offer to try to settle our case (75% of the principle amount). My solicitor did not inform me of a deadline date for accepting this offer. While considering whether to accept or decline the offer we received another email from the solicitor stating that the final court hearing had now already taken place. I was told that the case had finished in the first instance and we were only waiting for the ruling of the Court.

I was fuming that after nearly 10 years of fighting to get my money back, I had the potential of recouping some of the lost money, however we were uninformed of the offer deadline date.

At the start of this week we received another email from the solicitor stating that WE HAD LOST THE CASE! We now have 20 Court working days to appeal the judgment.

All of the above events seem very suspicious. Can anyone help with some advise or provide information on own experiences in getting money back from this development?

 Chindo - great news I am pleased for you. Could you tell me who your lawyers are because mine just seem so slow and keep on blaming the courts and the administrators of the slow progress. My lawyers are Fuster Associates in Los Alcazares.

I spoke to my lawyers this week and they told me to be patient. However, I think 4 years is long enough to be patient! They are confident I will get refund of my bank guarantee deposit but they will not give a timescale now, but after hearing your news there may be some possibility of recovering some of my deposit.

Dear all

It has been 5 months since the last message has been posted. Is anyone closer to getting any money back? I appear to be no further forward because the developer will not cancel my contract and therefore the bank will not refund my money until the contract is cancelled. There seem to be so many inconsistencies with individuals claims and recoveries of deposits.

I look forward to any further updates.

Still no deposit back. I have been chasing my solicitor up for weeks. I doubt i will now get a response now until September due to holidays. But I am due to visit Spain in September so hopefully I will have some news to report. I will keep you informed.

Likewise, I have been waiting longer than you have and it's taking too long especially as others seem to have had their money returned. I will chase my solicitor up next week, because I feel they will use the excuse of the Spanish holiday month for August which will delay proceedings.

If I hear any news on timescales I will post a response.
