We have just returned from Duquesa Fairways where we met Jale's representative, Javier Diaz, who was very pleasant and helpful.  We were pleased to find that our apartment had been cleaned and some of the snags had already been dealt with, leaving only a couple outstanding which we were promised would be done shortly.  Javier advised us that the footpath cracks and the gardens would be worked on after the summer.  We hope to complete on Wednesday and are very much looking forward to moving in in August.

We now feel that it is important that we all turn our attention to creating a strong community that will give AMMEX or whoever a clear mandate to manage the common areas of the complex to the benefit of us all.

The main delay in the construction programme was the time taken to resolve the issue of responsibility relating to the ground investigation report and then developing and implementing a solution. Overall it probably took about two years and you may recall no work was carried out in the 'gap' while this was going on. So if Jale are now involved in an insurance claim it could take years to resolve and the lack of a license could be an elaborate smoke screen to keep us all in the dark. Remember at one stage it was going to be phased, then it was cranes in the street, then it was the townhall in Manilva, then we moved to Seville and the latest is Estapona-all very convenient if you are fighting an insurance claim.

Our lawyer is unable to get any firm news from Jale's lawyers.Even in Spain there must be some basic consumer rights regarding a seller's obligations to keep customers informed of delays. It is hard to imagine this happening anywhere else in Europe. It's worse than dealing with some banana republic in the Third World. We have considered making representation to the local Euro MP but he/she will only be  concerned with protecting the region's reputation and big businesses.In the UK we have the Freedom of Information Act which is probably enshrined in EU legistlation. Therefore, it seems to us time to bypass the lot and start legal proceedings using a law firm perhaps from Madrid or Barcelona but certainly not Malaga to see if we can get to the bottom of this.

We will keep you posted.

I suspect a lot of people including local lawyers, estate agents, architects know or have a very good idea what is actually going on and a discreet veil of silence is easier than to report to their expat clients.

We have all suffered the despair of mis-information and broken promises. However, other than minor snagging, the complex is now complete.

We understand that due to all the problems relating to dodgey money etc. the Manilva authorities are required to have their decisions regarding Habitation Licenses  'rubber stamped' by the regional authorities in Seville and that this is about to happen.

Therefore, this may not be the time to pull out.

It might help but this is a clearer translation of Jale's message:

A document has been delivered to the community owners in which we promise to check and mend the painting of the common areas and cracks once all the land has settled.

Cenfloran is looking after the maintenance of the gardens and pools but it must be pointed out that the area in the middle of the complex has just been finished so it won't have the same appearance as those finished some months ago.

The boundary around the swimming pool area is a normal, safe, metallic fence.  In any case, the  position of the "tensar reinforced earth embankment face"  will be checked.
