Does anyone  have a formal  note of the date when the cerificate of final occupation license  was granted on phase 2 on Calas del Pinar. We know  it was applied for in May 2008.

 We are plot 14, but know they have now been renumbered now that some are occupied.

A fax was sent to  both Peinsa and the Bank through our solicitor Maria del Castro at a  cost of 1500 euros, but  the date when the final habitation was granted was never established by the solicitor so we have never been advised when the final certificate  was granted by Pulpi.

 Now that we have appointed a new solicitors and incurrinmg even more costs, we do need this information to fight our case for a refund . I thought I would use the forum to try and get some feedback on this before we went though the channels  of contacting Pulpi.

As a matter of interest, we have never  been advised by either the developer or the agent that the property is complete and issed with a completion and entry date.

Paul, we are coming out on 3rd-12th October if you fancy meeting up.
 We are staying in Mojacar but will be visiting the site since we are trying to pull out of Phase 2 and having quite a battle.

Does anyone have a recommendation and conact details for Notary who can do power of attorney signature and seal , as well giving us some  indication of cost.

 We are coming out next week and rather than use one in Manchester, thought  we would do it  'locally 'and lodge it with our new solicitor. Saves taking even more time off work to travel into Manchester.

 We are staying in the mojacar area, but anywhere in and around San Juan would be equally suitable.

Has anyone else been advised that an application for a habitation license, constitutes a legal completion on a property.


 We are trying to withdraw from our purchase on phase 2 which was due for completion in Feb 06 and have been told that we are unable to do so because  the habitation license has been applied for. We have been asking to withdraw for months and were initally advised by our solicitors that  we needed a renewed bankers guarantee. This has been applied for by the solicitors and also by ourselves by writing to Peinsa HQ direct. We had no replies and no renewed guarantees.

 The next thing we heard was the application for the habitation license and  told we were unable to withdraw since we were in a completion stage.

They are saying that we have therefore legally completed.

 Any feedback  on this would be really helpful, since like all the other comments noted, we are getting no where with anyone.
We are on the brink of engaging a London solicitor who specialises in Spanish property law  so all feedback gratefully received.
